药品领域反向支付问题研究

【摘要】：反向支付问题是创新药和仿制药竞争与博弈机制下难以回避的情形。随着国内仿制药产业的发展和药品专利制度的改革,以及创新药专利悬崖期的到来,反向支付问题将可能大量涌现。本文通过梳理与反向支付问题有关的典型案例及审查适用原则,希望对我国完善药品专利制度和反垄断执法工作有所帮助。
[Abstract]:The reverse payment problem is unavoidable under the competition and game mechanism of innovative drugs and generic drugs.With the development of domestic generic drug industry, the reform of drug patent system, and the arrival of patent cliff period, reverse payment problems may emerge in large numbers.By combing the typical cases related to reverse payment and examining the applicable principles, this paper hopes to be helpful to improve the drug patent system and anti-monopoly law enforcement in China.
