【摘要】：自20世纪50年代开始,核能已经有了70多年的发展历史。在石油和煤炭资源日益枯竭的今天,核能也成为了许多国家解决其能源匮乏问题的首要选择。核能的发展是一把双刃剑,它能够带给我们福利,但同时也有着很大的安全隐患,即使核事故发生的概率很小,可一旦发生其后果是我们无法估计的。自核能投入民用领域以来,世界上的主要核能大国如美国、日本等为了确保民用核能的安全发展,都制定了核损害民事赔偿相关的法律。我国作为一个未来的民用核能大国,核损害民事赔偿的相关规定是非常滞后的,因此我国急需建立和完善核损害民事赔偿的法律制度。本文主要是研究核损害民事赔偿的基本问题,通过总结核能利用比较发达国家的核损害民事赔偿法律制度并与我国目前的核损害民事赔偿制度进行对比,总结出我国现行的核损害民事赔偿法律制度的不足之处,并提出一些完善的建议。本文一共有六个部分。第一部分是导论,介绍了本文的选题意义以及国内外的研究现状。第二部分是本文正文第一章,介绍了核损害以及核损害民事赔偿制度,与一般的侵权赔偿和环境损害赔偿进行了比较分析。第三部分是对有关核损害民事赔偿的国际公约以及主要国家的相关立法进行了归纳分析。在本文中分析了几个主要原则,并通过对这些原则的分析以及结合我国的基本国情总结出对我国的启示。文章的第四部分是对我国目前的核损害民事赔偿法律制度进行分析。我国目前并没有一部完整的关于核损害民事赔偿的法律或者是原子能法,通过对我国现行的相关规定的分析,总结出我国现行核损害民事赔偿相关规定的不足之处。第五部分是对我国核损害民事赔偿法律制度的完善提出建议。在该部分分析了我国建立原子能法或者核损害民事赔偿法的重要性,并且对赔偿范围、赔偿程序以及赔偿限额等方面的完善提出建议。
[Abstract]:Since the 1950 s, nuclear energy has been developed for more than 70 years.With the depletion of oil and coal resources, nuclear energy has become the first choice for many countries to solve their energy shortage.The development of nuclear energy is a double-edged sword, it can bring us welfare, but at the same time there are also great safety risks, even if the probability of nuclear accidents is very small, but once its consequences are impossible to estimate.Since the nuclear energy has been put into the civilian field, the major nuclear power countries such as the United States and Japan have formulated civil compensation laws for nuclear damage in order to ensure the safe development of civil nuclear energy.As a large country of civil nuclear energy in the future, the relevant regulations of civil compensation for nuclear damage are lagging behind, so it is urgent for our country to establish and perfect the legal system of civil compensation for nuclear damage.This paper mainly studies the basic problems of civil compensation for nuclear damage, through summing up the legal system of civil compensation for nuclear damage in developed countries and comparing it with the current civil compensation system for nuclear damage in China.The deficiencies of the current civil compensation system for nuclear damage in China are summarized, and some suggestions are put forward.There are six parts in this paper.The first part is an introduction, which introduces the significance of this paper and the current research situation at home and abroad.The second part is the first chapter of the text, which introduces the nuclear damage and the civil compensation system of nuclear damage, and makes a comparative analysis with the general tort compensation and environmental damage compensation.The third part summarizes and analyzes the international conventions on civil compensation for nuclear damage and the relevant legislation of major countries.In this paper, several main principles are analyzed, and through the analysis of these principles and combined with the basic situation of our country, the enlightenment to our country is summarized.The fourth part is to analyze the current civil compensation system of nuclear damage in China.There is not a complete law on civil compensation for nuclear damage or atomic energy law in our country at present. Through the analysis of the relevant regulations of our country, the deficiencies of the relevant provisions on civil compensation for nuclear damage are summarized.The fifth part is to make suggestions on the perfection of civil compensation system for nuclear damage in China.In this part, the importance of establishing atomic energy law or civil compensation law for nuclear damage in China is analyzed, and suggestions are put forward to perfect the scope, procedure and limitation of compensation.
