论表演者权的法律保护模式之选择

【摘要】:表演者权是表演者对其表演所享有的专有性权利,区别于作者的表演权。表演者权产生于作品传播技术的进步,随着录制及传播技术的不断出现,表演者失去了对自己“表演”的控制,法律亦形成了对表演者权保护的制度回应。目前,表演者权的法律保护已逐渐在各国形成了多种模式的选择。本文通过对表演者权进行保护的代表性国家之保护模式进行考察,分析了这些模式产生的理论基础以及存在的合理性和不足之处。同时,采用比较分析的方法,对著作权体系国家和版权体系国家表演者权保护的立法所依据的理念差异进行分析,阐释了表演者权的保护模式之不同和各模式下的权利内容之差异等。通过对不同模式的基础理论分析,以独创性为视角,厘清了表演者权的本质,对表演者权采用“两分法”进行归类,主张对创作高度高且符合作品构成标准的表演行为以著作权制度保护;对创作高度较低的表演行为以邻接权制度保护。采用“两分法”对表演行为进行保护,体现立法的公正、公平。本文主要分为四个部分:第一部分,对表演者权及其法律保护模式进行一般性考察,厘清表演者权产生背景和发展轨迹,进而整体把握表演者权的保护模式。第二部分,首先分别介绍表演者权法律保护的典型模式,对各理论基础进行分析,考察各保护模式的立法实践,再对各保护模式进行比较研究,评析其合理性和不足。第三部分,对各国的独创性要求进行考察,再从独创性角度对表演者权的本质进行分析,进而得出独创性与模式选择的关联性,以及表演者权以著作权制度保护的可能性。第四部分,检视我国表演者权保护的现状,并对其进行完善研究。把创作高度高的表演者权纳入著作权保护范畴,对创作高度较低的表演者权进行邻接权保护,不具有独创性的表演行为不给予保护。比较分析不同国家对表演者权的保护模式,并不能以某一种保护模式的立制而告终。不同国家采取不同的模式,都有其存在的原因和理由,结合本国的实际情况,采用最适合本国国情的保护方式,既体现对表演者的权利之保护,又不损害作者的权利,才是著作权法的目标所在。
[Abstract]:The right of performer is the performer enjoys exclusive rights to their performance, performance rights from the author. At present, the legal protection of the rights of performers in the world has gradually formed a variety of model selection.
