住宅小区配套设施的权属认定

【摘要】:商品房发展迅猛,住宅小区相应的配套设施的种类繁多,但配套设施的权属存在认定不清的尴尬局面,容易引发业主、开发商等主体间的利益纠纷。现有法律框架下关于配套设施产权归属的认定较为模糊,需进一步确定权属认定依据。通过对配套设施进行准确定性、定位,对产权认定方法进行评议取舍,详细分析、总结全国典型地区的相关地方性立法,创新性地提出以建设目的作为权属认定依据。以建设目的作为权属划分依据,以国有土地出让合同以及建筑规划作为建设目的之具体依托,能较好地将权属加以区分,将配套设施相应地分类成归政府所有、归业主共有和归开发商所有的配套设施。在建设目的作为权属认定依据的具体适用上,选取争议性较大的地下车库、人防工程和底层架空层作为研究对象,以体现建设目的之适用价值。本文研究的内容分为以下三个部分:第一部分主要介绍研究对象,即先把研究范围限定为住宅小区,然后对配套设施进行准确的定性与定位,对配套设施的权属争议现状进行简单描述,并阐明权属不明所面临的不良影响。第二部分为文章的重点部分,首先评议当前理论或实务中现有的权属认定依据,然后重点提出笔者对配套设施权属的划分依据——建设目的,对应地将配套设施进行三大权属分类划分,并为后续研究特殊配套设施的权属作理论铺垫。第三部分针对特殊配套设施(地下停车库、人防工程和底层架空层)的权属认定作具体的分析论证,以建设目的为权属划分依据对其进行相应的权属认定。
[Abstract]:The development of commercial housing is swift and violent, and the corresponding supporting facilities are various in the residential district, but the ownership of the supporting facilities is in an awkward situation, which can easily lead to interest disputes between owners, developers and other subjects.Under the existing legal framework, the identification of the property right of supporting facilities is rather vague, and the basis of ownership determination should be further determined.Through the accurate qualitative analysis of supporting facilities, positioning, evaluation of the method of property rights determination, detailed analysis, summing up the relevant local legislation in typical areas of the country, innovatively put forward to the purpose of construction as the basis for ownership.Taking the purpose of construction as the basis for the division of ownership, the contract for the transfer of state-owned land and the building planning as the concrete support for the purpose of construction, the property rights can be better distinguished, and the supporting facilities can be classified into government ownership accordingly.Owned by the owner and owned by the developer of all supporting facilities.In order to reflect the applicable value of the construction purpose, the paper selects the controversial underground garage, civil air defense engineering and the understory overhead layer as the object of study on the specific application of the construction purpose as the basis for the ownership determination.The content of this paper is divided into the following three parts: the first part mainly introduces the research object, that is, the scope of the research is limited to the residential district, and then the matching facilities are accurately defined and positioned.This paper briefly describes the status quo of ownership disputes of supporting facilities, and clarifies the adverse effects faced by unknown ownership.The second part is the key part of the article. First, the author reviews the current theory or practice of the existing tenure identification basis, and then puts forward the author's division of supporting facilities ownership basis-the purpose of construction.This paper classifies the supporting facilities into three categories and lays a theoretical foundation for further research on the ownership of special supporting facilities.The third part analyzes and proves the ownership of special auxiliary facilities (underground parking garage, civil air defense engineering and overhead layer), taking the purpose of construction as the basis for the division of ownership.
