中医药的知识产权保护研究

【摘要】：中医药是中华民族文化的重要组成部分,是经过世世代代的努力传承几千年的民族瑰宝。随着养生保健、绿色生活等观念深入人心,中医药以其“天然”、“温和”的特性逐渐被世界各国人民关注。在“绿色”、“环保”的主题下,中医药行业也蕴含了巨大的发展潜力。可是,国际医药公司大力研发中医药技术,强势进军中医药市场,大量中医药被外国企业抢先申请专利。而国内中医药企业技术创新质量低、数量少,严重阻碍了国内传统中医药企业的发展。国内中医药行业腹背受敌,怎样更好发展中医药产业,除了中医药技术上的革新和中医药行业从业人员的规范,还需要法律制度的协助。现行的知识产权法对于中医药的保护起到了积极正面的作用,但是规定还不够详细,有一定的不可操作性。国际上对于中医药的知识产权保护一直未有行之有效的规定出现。众所周知,有效的保护是中医药传统文化资源传承和发展的必要条件,对传统中医药提供有效的知识产权保护,不仅符合我国的经济利益,还有利于在世界范围内弘扬中华文化。因此有必要结合知识产权制度,助力中医药产业的发展。鉴于中医药自身的复杂性,本文首先阐述中医药的特征,结合知识产权保护制度的特点,界定中医药知识产权的范围。其次总结中医药专利保护、商业秘密保护、行政保护的现状,找出问题所在。然后分析完善中医药知识产权保护的必要性和可行性。现行中医药知识产权法律法规之间的矛盾冲突导致中医药技术创新能力低下,中医药国际标准的缺失阻碍了中医药国际化进程。但是,人们对保护中医药的观念已经改变,国外相关国家的实践也论证了中医药知识产权保护的可行性及可能带来的重大经济效益。文章重点讨论中医药的专利权保护和中医药的技术秘密保护的优劣,中药品种保护、中医药的商标权保护、中医药地理标志保护等存在的问题。最后意图建立和完善中医药数据库以供国内外专利机构审查专利、加速中医药标准从地方标准到国家标准的历程、整合中医药企业结构并建立中医药专利联盟、国际基金会等中医药集体组织协助中医药企业国际市场的开发。此外,在制度层面上,对中医药知识产权保护制度的改革提出一点思考。
[Abstract]:Chinese medicine is an important part of Chinese culture and a national treasure for thousands of years.With the concept of health care, green life and so on deeply rooted in the people, traditional Chinese medicine with its "natural", "mild" characteristics gradually attracted the attention of people all over the world.Under the theme of "green" and "environmental protection", TCM industry also contains great potential for development.However, international pharmaceutical companies vigorously research and development of traditional Chinese medicine technology, enter the Chinese medicine market, a large number of foreign enterprises to apply for patents.The low quality and quantity of technical innovation in Chinese medicine enterprises seriously hinder the development of traditional Chinese medicine enterprises.The Chinese medicine industry in China is suffering from the enemy. In addition to the innovation of Chinese medicine technology and the standardization of the practitioners of traditional Chinese medicine, it also needs the assistance of the legal system to better develop the Chinese medicine industry.The current intellectual property law plays a positive role in the protection of traditional Chinese medicine, but the regulations are not detailed enough and not operable.International intellectual property protection for Chinese medicine has not been effective provisions.As we all know, effective protection is a necessary condition for the inheritance and development of traditional Chinese medicine cultural resources. It is not only in the economic interests of our country to provide effective intellectual property protection to traditional Chinese medicine,It is also conducive to the promotion of Chinese culture around the world.Therefore, it is necessary to combine the intellectual property system to help the development of traditional Chinese medicine industry.In view of the complexity of traditional Chinese medicine, this paper firstly expounds the characteristics of Chinese medicine and defines the scope of intellectual property rights of traditional Chinese medicine combined with the characteristics of intellectual property protection system.Secondly, summarize the current situation of patent protection, trade secret protection and administrative protection, and find out the problem.Then it analyzes the necessity and feasibility of improving the protection of intellectual property rights of traditional Chinese medicine.The conflict between the laws and regulations of intellectual property right of traditional Chinese medicine (TCM) leads to the low ability of technological innovation of TCM, and the lack of international standard of TCM hinders the process of internationalization of TCM.However, the concept of protecting traditional Chinese medicine has been changed, and the practice of foreign countries has demonstrated the feasibility of intellectual property protection of traditional Chinese medicine and the great economic benefits it may bring.This paper mainly discusses the problems existing in the protection of patent right of Chinese medicine and the protection of technical secret of traditional Chinese medicine, the protection of varieties of traditional Chinese medicine, the protection of trademark right of traditional Chinese medicine, the protection of geographical indication of traditional Chinese medicine, etc.Finally, it is intended to establish and improve the database of Chinese medicine for the examination of patents by domestic and foreign patent agencies, accelerate the course of Chinese medicine standards from local standards to national standards, integrate the structure of traditional Chinese medicine enterprises and establish a patent alliance for traditional Chinese medicine.International Foundation and other Chinese medicine collective organizations to assist Chinese medicine enterprises in the development of the international market.In addition, on the institutional level, the reform of intellectual property protection system of traditional Chinese medicine is put forward.
