【摘要】：当代科学技术的跨越式发展及信息时代的到来,使人们的生活、工作发生了翻天覆地的变化,QQ、微信、微博、E-mail、网络店铺、网络游戏、网络日志、电子文档资料等网络产物不断涌现,并逐渐成为我们日常生活、工作的重要组成部分。如今数字产业发展迅速并显露出极大的潜在价值,成为了社会新的经济增长点。这些倾注着众多网络用户的精力、时间和金钱的数字财产,不仅有着不菲的经济价值,并且包含着巨大的情感价值。随着互联网普及程度的深入,数字财产也在呈倍数增长,而第一代网民的也在逐渐老去,这些饱含价值的数字财产的继承问题开始突出。现实社会中陆续出现数字财产继承纠纷的案例,但相关司法机关办案却无法可依,这样下去势必会影响社会的安定,而法律作为定纷止争的利器,必须出台相应规定以规范数字财产继承产生的问题,况且当下互联网时代下那些数字财产的价值难以估量,若其无法继承难免造成社会财富的浪费,所以我们必须未雨绸缪,开始探索和构建数字遗产继承法律制度。本文主要研究了数字遗产的有关理论,证成数字财产可纳入遗产继承的范围,论证数字遗产继承的正当性,分析了我国数字遗产的继承现状,考察了国内外数字遗产研究现状及已有的数字遗产继承制度,最后提出我国数字遗产继承的解决思路。此论文的主要内容笔者从以下四方面进行阐述:第一部分是针对数字遗产继承这一事物进行相关理论的纯粹通释,各处舆论中数字遗产继承的相关案例甚嚣尘上,电子交易和互联网的联袂牵手便利了人们平常生活和工作,其地位不可小觑,本文着重通过对重要地位的阐述来说明数字财产继承问题的不可回避性,数字财产继承需要深入讨论,数字财产的概念作为当下的新潮事物也需要详细界定。数字遗产的特征有哪些?数字遗产的法律属性又有哪些?哪些相似概念需要与其辨析?存在即合理,数字遗产继承制度的存在也有其事物发展的客观存在性,所以,笔者将在本文第二部分探讨构建数字遗产继承制度的必要性和可行性即正当性分析。本文第三部分将视野从理论性剖析拉回现实境界,主要分析了当下我国社会纷繁环境下数字遗产继承面临的现实困境和其成因。从横向思维出发,学习与分析国外对本文相关问题的研究成果后,本文第四部分考察了国外数字财产继承的现状,域外制度的优点或缺点都是本文需要全面考虑的,无论理论和实践,本文进行了大量总结,在借鉴与吸取域外数字财产继承制度的成功先例和精髓后,本文将把视野拉回国内,立足我国国情,本着从宏观建树微观详细的想法,构思建设我国数字遗产继承制度的具体内容和路径。
[Abstract]:The leapfrogging development of modern science and technology and the arrival of the information age have made people's lives and jobs undergo earth-shaking changes QQQ, WeChat, Weibo E-mail, online shops, online games, online logs,Electronic documents and other network products are emerging, and gradually become an important part of our daily life and work.Nowadays, the digital industry is developing rapidly and showing great potential value, which has become a new economic growth point of the society.These digital assets, which pour into the energy, time and money of many network users, are not only of great economic value, but also of great emotional value.With the deepening of the popularity of the Internet, digital property is also in multiple growth, and the first generation of Internet users are also gradually aging, these rich value of digital property inheritance problems began to stand out.In real society, there have been cases of disputes over the succession of digital property, but the relevant judicial organs cannot handle cases according to them. This will inevitably affect the stability of society, and the law will serve as a sharp weapon for settling disputes over disputes.Regulations must be put in place to regulate the problems arising from the inheritance of digital property. Moreover, the value of those digital properties in the current Internet age is incalculable. If they cannot inherit, it will inevitably cause a waste of social wealth, so we must plan ahead.Start to explore and construct the legal system of digital heritage inheritance.This paper mainly studies the theory of digital heritage, proves that digital property can be brought into the scope of inheritance, demonstrates the legitimacy of digital heritage inheritance, and analyzes the status quo of digital heritage inheritance in China.The present situation of digital heritage research at home and abroad and the existing digital heritage inheritance system are reviewed. Finally, the solution of digital heritage inheritance in China is put forward.The main content of this paper is described from the following four aspects: the first part is a pure interpretation of the theory of digital heritage inheritance.The combination of electronic transactions and the Internet facilitates people's daily life and work, and their status is not to be underestimated. This paper focuses on the importance of explaining the inescapable nature of the problem of digital property inheritance.Digital property inheritance needs to be discussed in depth, and the concept of digital property as a trendy thing also needs to be defined in detail.What are the characteristics of digital heritage?What are the legal attributes of digital heritage?What similar concepts need to be identified and analyzed?Existence is reasonable, and the existence of digital heritage inheritance system has its objective existence of development. Therefore, in the second part of this paper, the author will discuss the necessity and feasibility of constructing digital heritage inheritance system, that is, legitimacy analysis.The third part of this paper draws the vision back to the realistic realm from the theoretical analysis, mainly analyzes the realistic predicament and its cause of formation of the digital heritage inheritance under the complicated social environment of our country at present.From the perspective of horizontal thinking, the fourth part of this paper investigates the status quo of digital property inheritance in foreign countries. The advantages and disadvantages of the extraterritorial system are all need to be considered in this paper.Regardless of theory and practice, this article has carried on a large number of summary, after drawing lessons from and absorbing the successful precedent and essence of the extraterritorial digital property inheritance system, this paper will draw the vision back to our country, base on the national conditions of our country, in line with the idea of building the macroscopic, microscopic and detailed,Conceive the concrete content and path of constructing our country's digital heritage inheritance system.
