【摘要】：开放获取能减少获取科学成果的阻力,使科学成果的传播更广泛,有助于促进生产力发展和经济文化的繁荣。目前对开放获取版权管理的讨论主要集中在需要保障权利人的哪些权利,以及如何确保免费许可的权利能得到合理利用。处理好版权管理问题涉及到平衡各相关利益主体的利益,需要满足各方的最大利益需求,以减少利益冲突。对比国内外开放获取期刊和知识库的版权管理模式,发现我国开放获取版权管理缺少全国统一的指导原则,不利于其长远发展。转型的开放获取期刊在期刊版权关系中仍处于主导地位,不利于引导其他开放获取组织的版权管理和作者对开放获取论文的自主支配。对开放获取论文的合理使用也存在多重问题,包括缺失救济机制、使用者责任不清晰和期刊对知识库收录开放获取论文的规定不明确等问题。针对我国开放获取版权管理存在的问题,结合我国实际情况和国外版权管理的成熟模式,提出加强行政监管、推动行业内部制度完善和促进相关法规的确立的建议,以构建我国开放获取版权管理健康发展的运行框架。
[Abstract]:Open access can reduce the resistance to obtaining scientific achievements, make the dissemination of scientific achievements more extensive, and help promote the development of productivity and the prosperity of economy and culture.The current discussion of open access to copyright management focuses on what rights need to be protected and how to ensure that the rights of free licenses are reasonably utilized.To deal with the problem of copyright management well involves balancing the interests of all relevant stakeholders and needs to meet the best interests of all parties in order to reduce conflicts of interest.By comparing the copyright management models of open access journals and knowledge bases at home and abroad, it is found that the lack of a unified national guiding principle of open access copyright management in China is not conducive to its long-term development.The transformation of open access journals is still in the dominant position in the copyright relationship of periodicals, which is not conducive to guiding the copyright management of other open access organizations and the author's autonomy over open access papers.There are also many problems in the rational use of open access papers, including the lack of relief mechanism, unclear user responsibility and unclear rules on the inclusion of open access papers in the knowledge base in journals.In view of the problems existing in the management of open access to copyright in our country, combined with the actual situation of our country and the mature mode of copyright management abroad, some suggestions are put forward to strengthen the administrative supervision, to promote the improvement of the internal system of the industry and to promote the establishment of relevant laws and regulations.In order to construct the framework of healthy development of open access copyright management in China.
