动物园动物损害责任问题研究

【摘要】：近些年来,大部分市民选择在闲暇时间陪孩子、家人、朋友一同去动物园游玩。动物园动物伤害游客的事件也愈发常见。尽管《侵权责任法》立法时对此问题的重要性和复杂性作了考虑,也对动物园动物损害作出规定,但在法律适用及理论研究上仍存在较多争议。对此,本文将从动物园动物造成他人损害承担责任问题的立法、司法及理论研究等方面深入分析,提出完善我国动物园动物致人损害承担责任问题的相关立法建议,让《侵权责任法》对于受害者的保护更为科学和有力。本文拟通过以下几个部分针对动物园动物造成他人损害后归责问题进行深入探讨。第一部分,以引言简单对本文的选题、国内外研究情况和论文创新点予以介绍,让读者了解本文的选题内容、写作思路、可供参考的地方。第二部分,主要阐述动物园动物损害概念、特征并通过与饲养动物损害进行比较,从而引出动物园动物损害问题。另外对动物园动物造成他人损害法律规定的立法背景作了详细介绍。第三部分,介绍了美国、加拿大、西班牙、荷兰、波兰等国家对动物园动物造成他人损害的民事责任承担有关法律规定。通过比较世界各国立法中关于此问题的立法背景、法律规定、判例、理论学说等内容,为本文第四部分提供依据。第四部分,在前几部分内容的基础上,详细论述我国动物园动物造成他人损害承担民事责任在立法上逻辑不清、语义不明的具体表现,在司法适用中难以达到保障当事人合法权益等问题。第五部分,鉴于动物园动物造成他人损害承担民事责任的规定存在缺陷,作者将通过法律解释或以修改法律的形式对该问题进行立法上的重构,并就多种方案予以比较分析,最终给出作者认为合理的解决方法。
[Abstract]:In recent years, most citizens choose to go to the zoo with their children, family and friends in their leisure time. Zoo animals are also increasingly common to hurt tourists. Although the importance and complexity of this problem are considered in the legislation of Tort liability Law, and the damage to zoo animals is also regulated, there are still many controversies in the application of the law and the theoretical research. In view of this, this paper will make a thorough analysis of the legislation, judicial and theoretical research on the issue of liability for damage caused by zoo animals to others, and put forward relevant legislative proposals to improve the problem of human damage and liability caused by zoo animals in China. Make the Tort liability Act more scientific and effective for the protection of victims. In this paper, the problem of imputation after animal damage caused by zoos is discussed in the following parts. The first part simply introduces the topic of this article, the domestic and foreign research situation and the innovation point of the paper with the introduction, lets the reader understand the selected topic content of this article, the writing thought, may provide the reference place. In the second part, the concept and characteristics of animal damage in zoos are expounded and compared with those in raising animals, which leads to the problem of animal damage in zoos. In addition, the legislative background of the legal provisions on the damage caused by zoo animals to others is introduced in detail. The third part introduces the relevant legal provisions of the United States, Canada, Spain, the Netherlands, Poland and other countries for the damage caused by zoo animals. The fourth part of this paper is based on the comparison of the legislative background, legal provisions, case law, theory and other contents of the legislation of various countries in the world. The fourth part, on the basis of the contents of the previous parts, discusses in detail the specific manifestation of the confusion in legislation and the unclear meaning of the civil liability of other people caused by zoo animals in our country. In the application of justice, it is difficult to protect the legitimate rights and interests of the parties. In the fifth part, in view of the defects in the provision of civil liability for the damage caused by zoo animals, the author will reconstruct the legislation by means of legal interpretation or amendment of the law, and make a comparative analysis of various schemes. Finally, the author gives a reasonable solution.
