我国消费者保护中冷静期制度的立法完善

【摘要】:市场经济日益繁荣,更多的营销方式出现在我们生活中。远程交易、上门交易等营销方式的新起,给消费者日常生活带来了诸多便利,但同时也存在着问题。这些新的营销方式在诸多方面有别于传统的交易方式。如远程交易的自身特点决定了消费者不能亲自现场检查商品质量,从而较为准确地判断是否购买。同样,在上门交易中,经营者往往突然出现在家中或工作场所,使消费者没有充分了解商品而直接签订合同,给日后纠纷埋下种子。 分析比照经营者与消费者的市场地位以及获取信息的能力,前者都明显优越于后者。因而,各国均通过立法来着重保护消费者利益,以实现公平正义和市场经济的稳定发展。我国也在适应市场发展的同时产生了冷静期制度,其赋予消费者在不超过收货后的法定时间内没有理由地单方撤销合同的权利,支持消费者的市场退出机制。 2013年10月,新《消费者权益保护法》在全国人民的期待下出台了,它将之前学者们热门讨论的冷静期制度规定在了25条中,此外,其他条文也多处流露倾斜保护消费者的立法意图,这在我国是一个标志性的进步。然而细细品读25条会发现,法条中有诸多细节没有明确提到,因而不同立场的人也会对此有不同的解读,这将阻碍实践操作的进程。因此,,这也是本文写作的目的和意义,希望通过对冷静期制度的分析,在借鉴各国先进经验的基础上,结合我国立法现状和不足,提出适用法律的实施细则,完善我国冷静期制度,以真正维护消费者合法权益。
[Abstract]:Market economy is flourishing day by day, more marketing way appears in our life. The new marketing methods, such as remote trading and door-to-door transactions, have brought many conveniences to consumers' daily life, but at the same time, there are still some problems. These new marketing methods are different from traditional trading in many ways. For example, the characteristics of remote trading determine that consumers can not check the quality of goods on the spot, so as to judge accurately whether to buy or not. Similarly, in door-to-door transactions, operators often suddenly appear in the home or workplace, so that consumers do not fully understand the goods and directly sign contracts to sow the seeds of future disputes. Comparing the market position of operator and consumer and the ability of obtaining information, the former is superior to the latter. Therefore, all countries adopt legislation to protect the interests of consumers in order to achieve fair and justice and stable development of market economy. China has also adapted to the development of the market at the same time to produce a cooling-off system, which gives consumers the right to cancel the contract unilaterally without reason within the legal time after receiving the goods, and supports the market withdrawal mechanism of consumers. In October 2013, the new Consumer Rights and interests Protection Act was introduced in anticipation of the nation's people. It provided for 25 items of the cooling-off period that had been the subject of popular discussion among scholars. Other articles also reveal legislative intent in favour of consumer protection, which is an iconic step forward in our country. However, a careful reading of article 25 shows that there are many details in the law that are not explicitly mentioned, so that people from different positions will have different interpretations of this, which will hinder the process of practical operation. Therefore, this is also the purpose and significance of this paper, I hope that through the analysis of the cooling-off period system, on the basis of drawing lessons from the advanced experience of other countries, combining with the current situation and shortcomings of our legislation, we can put forward the implementing rules of applicable law. Perfect our country cooling-off period system, in order to truly safeguard consumer legal rights and interests.
