社会治理创新视角下我国医疗纠纷处理的问题与对策

【摘要】：当前我国医疗纠纷的处理面临多元救济渠道缺乏、专业机构建设滞后、司法审判的权威性公正性有待提高等诸多难题,当事人面临的一系列救济困境又反馈到医疗纠纷的社会治理与演变进程中,甚至导致单纯的医患关系发展为严重的社会公共事件。医疗纠纷的解决也不再只是医患双方的问题,而是整个社会治理中的重要一环。因此,医疗纠纷的解决应当秉持源头治理、系统治理、依法治理和综合治理相结合的理念,在社会治理创新的大背景下,创新治理途径,建立以法治为核心,预防为首、多元结合,专项基金做保障的纠纷解决体系。
[Abstract]:At present, the treatment of medical disputes in our country is faced with many difficulties, such as the lack of multiple relief channels, the lag in the construction of professional institutions, the need to improve the authority and impartiality of judicial trials, and so on. A series of relief difficulties faced by the parties are fed back to the process of social governance and evolution of medical disputes, even leading to the development of a simple doctor-patient relationship into a serious social public event. The resolution of medical disputes is no longer just a problem between doctors and patients, but an important part of the whole society. Therefore, the resolution of medical disputes should be based on the idea of combining source management, system management, legal management and comprehensive management. Under the background of social governance innovation, we should innovate the ways of governance, establish the rule of law as the core, and take prevention as the first. Multiple combination, the special fund to do the protection of the dispute resolution system.
