我国宅基地使用权流转法律制度完善研究

【摘要】:宅基地使用权作为农民的一项重要财产,相应流转法律制度的完善,事关能否切实增加农民的财产性收入。而对于集体经济组织来说,是在集体土地所有权之上设立的一项用益物权,是集体土地所有权的延续,其是否可以流转关乎集体土地所有权的落实。而对于国家而言,作为一项土地资源,其是否可以在流转的基础上得到合理充分的利用,关系到社会资源的优化配置和经济的可持续发展。宅基地使用权制度发展至今已有数十年的历史,其诞生于我国的计划经济年代。经过三十多年的改革开放,该制度诞生之初的经济社会基础已发生极大变化。随着全面深化改革,城乡二元结构已成为制约城乡一体化进程的主要障碍。现行法律采取限制流转的立法态度,是城乡二元结构在宅基地领域的主要表现,亟需改革完善,以适应经济社会的发展。我们应该赋予宅基地使用权完整的用益物权权能,允许相关权利人在一定的条件下可以自由流转其宅基地使用权。流转法律制度的完善是权利配置正义的基本要求,也是我国物权法理论发展的重要体现。本文除去引言分为四个部分:第一部分:我国宅基地使用权流转法律制度的沿革,通过分析农村土地制度的历史变迁,梳理出该制度形成和发展的历史脉络,并且结合历史上的经济体制改革的时代背景,相应地,提出该制度诞生之初的城乡二元结构已经成为制约城乡一体化进程的主要障碍,亟需改革完善相关流转制度以适应全面深化改革的需要。第二部分:我国宅基地使用权流转的现实问题,通过考察我国现行法律在该领域的相关规定,从实证的视角检视了该领域法律制度存在的主要问题,相应地,指出该领域法律制度在原始取得方面存在的问题,并以此为论据,探讨该存在的问题对相关权利的流转的影响。第三部分:我国宅基地使用权流转的学理分析,主要站在法律理论的角度,分析探讨流转法律制度的法理基础。相应地,论证流转的合理性及其必要性,为流转法律制度的构建提供一定的法学理论支撑。第四部分:我国宅基地使用权流转法律制度的构建思路,通过对相关法律规定进行学理分析的基础上,继而为流转法律制度的构建提供一个总体性思路。相应地,在流转法律制度的前置条件、流转方式和流转主体及其利益分配方面提出构建的思路。
[Abstract]:The right to use homestead as an important property of the farmers, the improvement of the corresponding circulation legal system is related to whether the property income of farmers can be increased effectively. For the collective economic organization, it is a usufructuary right set up on the collective land ownership, the continuation of collective land ownership, and whether it can be transferred to the collective. The implementation of land ownership, for the state, as a land resource, whether it can be rationally and fully utilized on the basis of circulation, is related to the optimal allocation of social resources and the sustainable development of the economy. The development of the system of the right to use homestead has been developed for decades, and it is born in the planned economic year of China. After more than thirty years of reform and opening up, the economic and social foundation of the system has changed greatly at the beginning of the birth of the system. With the comprehensive deepening of the reform, the urban and rural two yuan structure has become the main obstacle to restrict the process of urban and rural integration. The present law adopts the legislative attitude restricting the circulation of urban and rural areas, which is the main manifestation of the two yuan structure in the field of homestead. There is an urgent need for reform and improvement to adapt to the development of the economy and society. We should give the right to use the complete usufructuary right of the homestead and allow the relevant rights holders to freely transfer their right to use their homestead under certain conditions. The perfection of the legal system is the basic requirement of the right allocation justice and the development of the theory of real right law in China. In this paper, the introduction is divided into four parts: the first part: the evolution of the legal system of the transfer of the right to use the homestead in China. Through the analysis of the historical changes of the rural land system, the historical context of the formation and development of the system is combed, and the birth of the system is put forward in the light of the historical background of the economic system reform in the history. The initial urban and rural two yuan structure has become the main obstacle restricting the process of urban and rural integration. It is urgent to reform and improve the relevant circulation system in order to meet the needs of comprehensive deepening of the reform. The second part: the practical problems of the transfer of the right to use homestead in China, through the inspection of the relevant provisions of the current law in this field, from the perspective of empirical examination of this The main problems existing in the legal system of the field, correspondingly, point out the problems existing in the original acquisition of the legal system in this field, and take this as the argument, and discuss the influence of the existing problems on the circulation of the related rights. The third part: the theoretical analysis of the transfer of the right to use homestead in China, mainly from the angle of the legal theory, analyzes the flow of the flow. Transfer the legal basis of the legal system. Accordingly, demonstrate the rationality and necessity of the circulation, provide certain legal theory support for the construction of the circulation legal system. The fourth part: the construction idea of the legal system of the transfer of the right to use the homestead in our country, on the basis of the relevant legal provisions, and then the legal system of circulation. The construction of degree provides a general idea. Accordingly, it puts forward the idea of constructing the precondition of the circulation of the legal system, the mode of circulation, the subject of circulation and the distribution of its interests.
