见义勇为者责任豁免研究

【摘要】：当今社会中,许多见义勇为者由于我国法律责任豁免条款的局限性,最终承担了本不应承担的法律责任。这样的结果导致了十分消极的社会影响,引发了对待陌生人救助问题的大众冷漠。面对这一亟待解决的困境,完善见义勇为者的责任豁免相关立法,成了解决这一难题的关键钥匙。要达成这一目的,需要对以下几个方面的问题进行深入探讨：见义勇为的概念和性质应如何界定、我国现行立法对于保护见义勇为者豁免权的局限于何处以及如何全方位地完善我国对见义勇为者责任豁免的立法。本文阐析了见义勇为和免责事由相关的法理学、民法学理论,并结合各国的立法实践,对完善我国见义勇为者责任豁免的立法进行了较为系统的探讨。在现有研究基础之上,对见义勇为者责任豁免的适用条件和适用情形等理论依据进行分析,找出现有的民事法律制度中对见义勇为者豁免权规定的不足之处。在此基础上构建我国完善见义勇为者责任豁免立法的思路,如进行全国性的见义勇为统一立法,并在该法案中设立对见义勇为者责任豁免的条款,以期对我国见义勇为的未来立法及其司法实践有所帮助。
[Abstract]:In today's society, many brave and righteous people bear the legal responsibility which should not be taken up because of the limitation of the exemption clause of legal liability in our country. This has led to very negative social effects, triggering public indifference to the problem of stranger rescue. In the face of this dilemma, perfecting the relevant legislation on the exemption of responsibility of the valiant has become the key to solve this problem. In order to achieve this goal, the following aspects need to be explored in depth: how to define the concept and nature of courage for good, The limitation of our current legislation on the protection of immunity of the righteous and brave and how to improve our legislation on the exemption of the responsibility of the righteous. This paper expounds the jurisprudence, civil law theory and the legislative practice of various countries, and probes into how to perfect the legislation on the exemption of the responsibility of the righteous and the brave in our country. On the basis of the existing research, this paper analyzes the applicable conditions and the applicable circumstances of the exemption from the liability of the righteous, and finds out the deficiencies of the immunity of the righteous in some civil legal systems. On the basis of this, the author constructs the train of thought of perfecting the exemption legislation of the responsibility of the righteous brave, such as carrying on the national uniform legislation of the righteous brave, and establishing the clause of the exemption from the responsibility of the righteous brave in the bill. It is expected to be helpful to the future legislation and judicial practice of our country.
