知识产权质押融资:实践、障碍与机制优化

【摘要】：拓展知识产权质押融资,对于提高知识产权使用效率,帮助中小微企业解决融资难题,助推企业技术创新,加快推进创新驱动发展战略实施具有重要意义。自2008年开展试点以来,我国知识产权质押融资取得了一定成效,但仍面临着知识产权质押融资法律体系不完备、质押登记机构不统一、价值评估机制不健全、风险防控机制不成熟、知识产权交易市场不完善等现实障碍。为推动我国知识产权质押融资进一步创新和发展,建议制定统一、完备的法律法规,建立具有广泛认可性的知识产权价值评估机制,完善融资风险补偿长效机制,加强知识产权交易平台和机制建设。
[Abstract]:It is of great significance to expand intellectual property pledge financing to improve the efficiency of intellectual property use, to help small and medium-sized enterprises solve financing problems, to promote technological innovation, and to accelerate the implementation of innovation-driven development strategy. Since the launch of the pilot project in 2008, China has achieved some results in the financing of intellectual property rights pledge, but still faces the imperfect legal system of intellectual property mortgage financing, the lack of unified pledge registration institutions, and the imperfect evaluation mechanism of the value of intellectual property rights. Risk prevention and control mechanism is not mature, intellectual property trading market is not perfect and other practical obstacles. In order to promote the further innovation and development of intellectual property rights pledge financing in China, it is suggested to formulate unified and complete laws and regulations, to establish a widely accepted mechanism for evaluating the value of intellectual property rights, and to improve the long-term mechanism of financing risk compensation. We will strengthen intellectual property trading platforms and mechanisms.
