司法推理的过程与规则——以保证金的民事执行问题为例

【摘要】：当前学界对司法推理的研究大多为静态研究,即对司法推理模式的介绍和类型化分析等知识论和宏观结构分析的层面,对司法推理的过程与规则缺乏研究。司法推理的过程与规则应分为两个层面:一是宏观过程与规则,即不同种类推理模式运用的逻辑顺序和适用情形。包括法律规范的选择,演绎推理、解释推理、类推适用、辩证推理的适用情形和相互之间的逻辑顺序;二是微观过程与规则,即规范选择、演绎推理、解释推理、类推适用、辩证推理等各种推理模式具体运用的步骤和条件,以及如何与逻辑学、语义学、社会学等分析方法的结合等。
[Abstract]:At present, the research on judicial reasoning in academic circles is mostly static research, that is, the introduction of judicial reasoning model and the analysis of types of knowledge and macro-structure analysis, and the lack of research on the process and rules of judicial reasoning. The process and rules of judicial reasoning should be divided into two levels: one is the macroscopic process and rules, that is, the logical sequence and application of different kinds of reasoning modes. Including the choice of legal norms, deductive reasoning, interpretation reasoning, analogy application, dialectical reasoning and the logical order of each other, the second is the microscopic process and rules, namely, normative choice, deductive reasoning, interpretation reasoning, and analogy application. The concrete application steps and conditions of various reasoning modes such as dialectical reasoning, and how to combine with logic, semantics, sociology and other analytical methods.
