论计算机“创作作品”的著作权保护

【摘要】：随着信息技术的发展,计算机"创作作品"在现实中大量出现,法律不得不对新技术引发的新问题作出回应。受制于独创性和作者资格的要求,计算机"创作作品"不属于著作权法意义上的作品,但其非物质性的客体本质在功利主义的支持下可扩张为著作权法的特殊保护对象,并可采用邻接权的保护模式。那些主要依赖程序运行、或用户虽能控制但无法改变运行结果的计算机"创作作品",作为计算机软件与操作系统互动产生的必然结果,被排除在保护范围以外。同时为了兼顾投资保护与公众利益,在计算机"创作作品"上仅设立为期十年的财产权,且该权利归属于用户。
[Abstract]:With the development of information technology, computer "creation" appears in large numbers in reality, and the law has to respond to the new problems caused by the new technology. Subject to the requirements of originality and authorship, computer "creation" does not belong to the works in the sense of copyright law, but its immaterial object nature can be extended to the special protection object of copyright law under the support of utilitarianism. And the protection mode of neighboring right can be adopted. Computer "creations" that rely primarily on the program to run, or that the user can control but cannot change, are excluded from protection as a corollary to the interaction between computer software and the operating system. At the same time, in order to balance the investment protection and the public interest, the property right is established only for ten years on the computer "creation works", and the right belongs to the user.
