宅基地使用权抵押的基本范畴与运行机制

【摘要】:允许宅基地使用权抵押,在法理论、法技术和法政策层面均可得到充分支持。在宅基地使用权抵押的法律关系中,抵押人并非独立于自然人的主体——“农户”,而是特定农户的全体家庭成员;客体应以登记确权的宅基地为限,并应遵循“房地一致”原则;抵押权人不应局限于金融机构。在宅基地使用权抵押的运行中,为疏解宅基地流转和耕地保护的矛盾,应当对超标宅基地抵押进行限制,并增设“新增宅基地抵押冷却期”制度。为平衡银行贷款风险和农民宅基地抵押经济价值,抵押权实现时,应当将不同实现方式层次化对待,并逐步拓宽受让人范围。同时应当设立风险基金作为宅基地保障功能的初步替代,并应鼓励采取信用保险与保证保险等保险方式为农户增信。
[Abstract]:Allow homestead right to use mortgage, in the legal theory, legal technology and legal policy level can be fully supported. In the legal relationship of mortgage of the right to use the homestead, the mortgagor is not the main body independent of the natural person-"peasant household", but all the family members of the particular peasant household, and the object should be limited to the homestead where the right of registration is confirmed. And should follow the "premises consistent" principle; mortgagee should not be limited to financial institutions. In order to solve the contradiction between the circulation of homestead and the protection of cultivated land in the operation of the mortgage of the right to use the homestead, we should restrict the mortgage beyond the standard, and add the system of "the cooling-off period of the new mortgage of the homestead". In order to balance the risk of bank loan and the economic value of peasants' homestead mortgage, different ways of realization should be treated hierarchically and the scope of transferee should be widened gradually when the mortgage is realized. At the same time, risk fund should be set up as the primary substitute for the function of homestead protection, and credit insurance and guarantee insurance should be encouraged to increase the credit for farmers.
