日本职务发明权属规则转变的梳理与借鉴——兼评2015年日本《特许法》修订

【摘要】:日本《特许法》第35条规定了关于职务发明权利归属的相关规则,在1921年和2015年两次《特许法》修订中,实现了由"雇主优先"到"雇员优先",再到"折衷主义"的转变,分别彰显了保障雇员发明人合法权益和促进发明成果转化运用的立法价值取向。我国职务发明权属规则随着1984年《专利法》的颁布而产生,运行中存在雇员与雇主之间权利配置不均衡等诸多问题,因此,有必要借鉴日本的立法经验,从法定规则的改进和完善及约定规则的扩张和限制两个方面提出应对举措。
[Abstract]:Article 35 of Japan's franchise Law stipulates the relevant rules concerning the attribution of the right to invention for duty. In the 1921 and 2015 amendments to the concession Law, the transition from "employer first" to "employee first" and then to "eclecticism" was realized. It shows the legislative value orientation of protecting the legitimate rights and interests of employee inventors and promoting the transformation and application of inventions. With the promulgation of the Patent Law in 1984, there are many problems in the distribution of rights between employees and employers. Therefore, it is necessary to learn from the legislative experience of Japan. The countermeasures are put forward from the aspects of the improvement and perfection of the statutory rules and the expansion and limitation of the prescribed rules.
