山寨游戏的知识产权法律规制研究

【摘要】:山寨游戏是近年来游戏产业领域持续繁荣的产物,出现这一问题的原因除了巨额的利益驱使外,因游戏本身的短周期性相对诉讼程序的漫长致拖延战术大有用武之地,加之山寨手段的复杂多变性、取证困难以及侵权认定的模糊导致维权成本高而使维权收效甚微。游戏主要分为计算机程序和数据资源部分,计算机程序隐藏在后台运行,通过响应玩家的操作而调取数据资源;数据资源则通过电脑屏幕和音响系统呈现给玩家,包括声音、角色、场景、语言对白、道具等。根据山寨侵权行为的方式,主要可以分三类:抄袭游戏的创意、玩法;抄袭游戏的组成元素如名称、玩法、角色形象、场景图,并经过替换、修改部分新要素进行模仿;模仿知名游戏的名称、形象或商标。本文在对游戏的法律属性进行界定后,分别对三类山寨行为所涉及的法律问题进行了分析。运用思想与表达二分法并结合最近具有较大影响的游戏知识产权纠纷案件,认定游戏的创意、玩法不属于思想的表达,不受著作权法保护,但可以通过不正当竞争法律予以规制。游戏的组成元素可以按独创性理论进行拆分保护。山寨侵权的判断标准在司法实践中存在着不同的理解,本文试图通过“实质性相似+接触”标准和独创性标准来明晰。在判定方法上,根据游戏的分部组成运用不同的方法判定。最后,针对山寨游戏产生的原因及特点,本文提出了完善法律分层规制体系、引导山寨企业模仿性创新和加大执法力度并发挥行业自律作用来规范引导游戏产业的健康发展。
[Abstract]:The Shanzhai game is the product of the continuous prosperity in the field of game industry in recent years. The reason for this problem is that apart from the huge profits driven by the game itself, the short periodicity of the game itself is much more useful than the long delaying tactics of the lawsuit procedure. In addition, the complex variability of shanzhai means, the difficulty of obtaining evidence and the ambiguity of tort identification lead to high cost of rights protection, which makes the effectiveness of rights protection very little. The game is mainly divided into computer programs and data resources, the computer programs run in the background hidden, by responding to the operation of the player to access data resources; data resources are presented to players through computer screens and audio systems, including sound, Characters, scenes, language dialogue, props, etc. According to the way of copycat infringement, it can be divided into three types: plagiarism game creativity, play, plagiarism game elements such as name, play, character image, scene map, and after replacement, modify part of the new elements to imitate; Mimic the name, image, or trademark of a well-known game. After defining the legal attributes of the game, this paper analyzes the legal problems involved in the three types of copycat behavior. By using the dichotomy of thought and expression and combining with the recent disputes over the intellectual property rights of the game, it is concluded that the creative nature of the game is not an expression of thought and is not protected by copyright law. But it can be regulated by unfair competition law. The elements of the game can be split and protected according to the original theory. The judgment standard of copyright infringement has different understanding in judicial practice. This paper tries to clarify the criterion of "substantial similar contact" and originality. In the determination method, according to the game of the composition of the use of different methods. Finally, in view of the reasons and characteristics of Shanzhai game, this paper puts forward to perfect the legal hierarchical regulation system, guide the imitation innovation of Shanzhai enterprise, strengthen the law enforcement and play the role of self-discipline in order to standardize and guide the healthy development of the game industry.
