互联网征信中金融隐私权的保护

【摘要】:中国金融制度长期存在“压抑”的现象,互联网极大地改造了中国的金融领域,互联网金融应运而生。总体来看,中国互联网金融起步的时间在全球并不算落后,在部分领域甚至已经成为业界领头羊。互联网金融在填补传统金融空白、推动普惠金融发展等多个方面起到了关键的作用,而互联网金融的健康发展有赖于完备的信用征信体系。我国p2p平台问题频发,不断有p2p平台圈钱跑路的一个根源便是我国征信体系的不完善以及征信水平的落后。互联网金融直接催生了对互联网征信的需求,同时互联网征信加入传统征信市场,有利于倒逼我国征信体系的改革,改变过去央行征信系统一家独大的局面,朝市场化、多元化的方向发展。央行2015年1月公布8家个人征信试点机构,其中芝麻信用、腾讯征信、考拉征信、前海征信均为定位于“互联网+大数据”的征信公司,我国的个人征信民营化开闸。互联网征信这样创新性的征信模式有别于传统征信方式,传统的征信规则难以适用。由于互联网征信本身的特点,如果按照现行规定,互联网征信机构在信息收集环节极容易侵犯用户的金融隐私权,比如未经当事人同意收集信息、收集法律禁止收集的信息。而我国的相应民事责任制度缺位,导致大量的受损害用户无法获得赔偿。不管是互联网征信的制度构建还是金融隐私权的保护在我国都处于起步阶段,相当不成熟,这些问题均值得我们探讨。美国白宫2014年发行“大数据”白皮书,进行了大数据与隐私的深入研究。近期,美国总统奥巴马签署法案,将美国部分隐私保护扩大至盟国公民,让个人信息遭到非法侵害的盟国公民也能控告美国政府。美国在隐私权保护方面不断进步,一直走在世界前列;欧盟执委会(European Commission)在2015年12月15日通过了《一般数据保护条例》(General Data Protection Regulation),希望通过建设完整的全新框架代替已经不能适应“互联网+”时代需求的陈旧框架。中国可以结合本土的实际情况适当的学习其做法和理念。

Overall, China's Internet finance started in the world is not lagging behind, in some areas has even become the industry leader. Internet finance plays a key role in filling the gap of traditional finance and promoting the development of inclusive finance. The healthy development of Internet finance depends on a complete credit system. The problem of P2P platform occurs frequently in our country. One of the root of the problem is the imperfection of credit system and the backwardness of credit information level. Internet finance has directly spawned the demand for Internet credit reporting. At the same time, Internet credit reporting has joined the traditional credit reporting market, which is conducive to pushing back the reform of our credit system, changing the situation in which the credit system of the central bank was dominant in the past and moving towards marketization. The direction of diversification. In January 2015, the central bank announced eight pilot institutions of personal credit, including sesame seed credit, Tencent credit, koala credit, Qianhai credit information company located in "Internet big data", and privatization of personal credit information in our country. The innovative credit reporting mode of Internet is different from the traditional credit reporting mode, and the traditional credit rules are difficult to apply. Because of the characteristics of Internet credit information, if according to the current regulations, Internet credit agencies in the information collection link is easy to violate the financial privacy rights of users, such as collecting information without the consent of the parties, collecting information prohibited by law. But our country's corresponding civil liability system is absent, resulting in a large number of injured users can not get compensation. Whether it is the construction of Internet credit system or the protection of financial privacy in China, it is still in its infancy, and these problems are worthy of our discussion. The White House released the White Paper "big data" in 2014, conducting in-depth research on big data and privacy. Recently, U.S. President Barack Obama signed a bill to extend some of the U.S. privacy protection to allied citizens, allowing citizens of allies whose personal information has been illegally infringed to sue the U.S. government. The United States has been in the forefront of the world in the protection of privacy; The European Commission adopted the General data Protection Regulation on December 15, 2015, hoping to replace the old framework that was no longer adapted to the needs of the "Internet" age by building a complete and new framework. China can combine the local actual situation to learn its practice and idea appropriately.
