知名形象商品化权的研究

【摘要】:随着市场经济的不断发展,竞争愈演愈烈,为了提高商品的市场知名度,刺激消费者的购买欲望,越来越多的经营者开始利用知名形象,将知名形象与其商品用各种方式联系起来,以此带来巨额的商业利润。于是在现代社会中,商品化权渐渐引起人们的广泛关注。国外关于商品化权的研究和立法要领先我们很多,我国对商品化及商品化权的研究还处于初级阶段。目前学界有不少学者已经对该问题进行了相关的理论研究,并取得了不错的成果,但是对商品化权的探讨都不够深入,没法形成系统的体系。与此同时,司法实践中关于商品化权的案例已经存在,而立法上的缺陷使的权利人无法准确表达自己的诉求,法官们也对法律适用感到困难重重,无法有效的解决此类纠纷。长此以往,将会引发越来越多的社会矛盾,我国社会主义市场经济的有序发展也会受到阻碍。鉴于此,笔者大胆的通过此文探析商品化权的法律关系,其法律制度的构建,以及当前环境下如何保护公民的权利。通过法律制度的构建,充分发挥法律的规范作用和社会作用,对关乎商品化权的社会矛盾与纠纷给予有效的法律规制,从而为我国社会主义市场经济的发展提供有力法律保障。本文大体上分为五个部分:第一部分为引言,叙述了商品化权的研究背景和意义、国内外目前对商品化权的研究情况、本文的主要研究方法、文章的创新点及缺点。第二部分对形象、知名形象、商品化、商品化权做了论述并在此基础上对知名人物商品化权的内容和法律关系做了进一步论述。第三部分从几个案例出发引出了目前国内存在的问题,而现行法律的相关规定无法有效解决这些问题,突显了知名形象法律保护的必要性和紧迫性。第四部分叙述了知名形象商品化权在大陆法系和英美法系国家的发展背景和立法保护现状及借鉴。第五部分叙述了我国如何创设商品化权,如何认定侵犯知名形象商品化的行为和如何进行法律救济。
[Abstract]:With the continuous development of market economy and the intensification of competition, in order to improve the market awareness of commodities and stimulate consumers' desire to buy, more and more operators have begun to make use of the well-known image. Connect the famous image with its goods in various ways, thus bringing huge commercial profits. Therefore, in the modern society, the right to commercialize gradually aroused widespread concern. Foreign research and legislation on the right to commercialize is much ahead of us, and the research on the right to commercialize and commercialize in our country is still in the primary stage. At present, many scholars have carried on the related theory research to this question, and obtained the good result, but the discussion to the commercialization right is not deep enough, cannot form the systematic system. At the same time, the case of the right of commercialization has already existed in the judicial practice, and the defects in the legislation make the obligee unable to express his demands accurately, and the judges also feel that the application of the law is very difficult, and they cannot effectively resolve this kind of dispute. In the long run, more and more social contradictions will arise, and the orderly development of our socialist market economy will be hindered. In view of this, the author boldly analyzes the legal relationship of commercialization right, the construction of its legal system, and how to protect the rights of citizens under the current environment. Through the construction of the legal system, we can give full play to the normative and social functions of the law, and give effective legal regulation to the social contradictions and disputes related to the right of commercialization, thus providing a strong legal guarantee for the development of our socialist market economy. This paper is divided into five parts: the first part is the introduction, describing the research background and significance of the commercial right, the current research situation of the commercial right at home and abroad, the main research methods of this paper, the innovation points and shortcomings of the article. The second part discusses the content and legal relationship of the right of commercialization of famous characters. The third part leads to the problems existing in our country from several cases, but the relevant provisions of the current law can not effectively solve these problems, which highlights the necessity and urgency of the legal protection of well-known image. The fourth part describes the development background and legislative protection of the right of commercialization of well-known image in the countries of civil law system and common law system. The fifth part describes how to establish the right of commercialization, how to determine the behavior of commoditization of the well-known image and how to carry out legal remedies.
