【摘要】：信息技术的快速发展使隐私权的保护面临许多前所未有的问题。2013年中央电视台3.15晚会让广大网民认识了Cookie这个网络技术名词,Cookie技术被归结为窃取网络用户隐私的重要技术手段。Cookie技术提高了网络用户体验,促进了互联网行业的发展,但也存在着危害用户隐私的可能性。如何对利用Cookie技术侵犯用户隐私的行为进行有效规制成为目前亟需解决的问题。目前,Cookie技术的隐私安全问题,绝大多数是从技术的角度来研究,从法学角度的研究并不是很充分。本文综合运用比较法、实证法、历史分析法,对Cookie技术的起源和发展进行介绍,结合对个人隐私和个人信息内涵、特征与区别的理论把握,分析Cookie技术个人信息保护方面可能存在的缺陷,通过对我国目前应对Cookie技术隐私问题的现状分析,对比参考欧盟的做法,指出我国Cookie技术隐私问题亟需进行立法规制,并需要充分发挥行业自律的作用和加强用户保护意识,提出了一些具体的应对措施。本文分为五章。第一章是网络时代Cookie技术的使用。本章首先介绍了Cookie技术的起源和类型,然后阐述了互联网时代Cookie技术发挥的巨大作用,最后分析了可能利用Cookie技术侵犯用户隐私的行为。第二章是隐私与个人信息。本章从理论层面介绍分析了隐私和隐私权的概念,以及和个人数据(资料)、个人信息的关系。第三章是我国应对Cookie技术隐私问题的现状。本章首先对我国目前规制Cookie技术的立法进行了梳理,然后指出我国目前立法规制存在的问题,最后介绍了我国行业自律的现状。第四章是欧盟应对Cookie技术隐私问题的现状。本章通过对欧盟规制Cookie的立法梳理和相关机构的介绍,分析了欧盟立法规制Cookie技术的焦点问题。第五章是我国应对Cookie技术隐私问题对策建议。基于前面章节的理论框架,通过对我国如何应对Cookie技术隐私问题的思考,提出了需要从国家、行业和个体三个层面的角度来应对,并提供了一些具体的措施建议。
[Abstract]:With the rapid development of information technology, the protection of privacy faces many unprecedented problems. The 2013 CCTV 3. 15 evening party made the vast number of Internet users aware of cookie, a term used in network technology, which is attributed to stealing the privacy of Internet users. Cookie technology improves the network user experience. Promote the development of the Internet industry, but there is also the possibility of endangering user privacy. How to regulate the behavior of infringing users' privacy by cookie technology becomes a problem that needs to be solved. At present, most of the privacy security problems of Cookie technology are studied from the point of view of technology, but not from the point of view of law. This paper introduces the origin and development of cookie technology by means of comparative method, empirical method and historical analysis method, combining with the theoretical understanding of the connotation, characteristics and differences of personal privacy and personal information. This paper analyzes the possible defects in the protection of personal information of cookie technology, through the analysis of the current situation of dealing with the privacy problems of cookie technology in China, and points out that the problem of cookie technology privacy in our country needs to be regulated by legislation by referring to the practices of the European Union. We need to give full play to the role of industry self-discipline and strengthen the awareness of user protection, and put forward some specific countermeasures. This paper is divided into five chapters. The first chapter is the use of cookie technology in the network age. This chapter first introduces the origin and types of cookie technology, then expounds the great role of cookie technology in the Internet era, and finally analyzes the possible use of cookie technology to violate the privacy of users. The second chapter is about privacy and personal information. This chapter introduces and analyzes the concepts of privacy and privacy, and the relationship between privacy and personal data. The third chapter is about the status of cookie privacy in China. This chapter firstly combs the current legislation of cookie technology in our country, then points out the existing problems of our country's current legislation regulation, and finally introduces the present situation of industry self-discipline in our country. The fourth chapter is the current situation of EU to deal with cookie technology privacy. This chapter analyzes the focus of EU legislation on cookie regulation through the introduction of EU legislation on cookie regulation and the introduction of relevant institutions. The fifth chapter is our country to deal with cookie technology privacy issues countermeasures. Based on the theoretical framework of the previous chapters, this paper puts forward some suggestions on how to deal with the privacy of cookie technology in China from the perspectives of country, industry and individual.
