【摘要】：登记制度是不动产物权的公示办法,就是把物权的变动事实写在国家规定的机关的簿册上。根据我国2007年颁布的《中华人民共和国物权法》(以下简称《物权法》)的规定,物权归属和内容的载体是不动产登记簿,它的保管工作由特定的登记机构负责,担负着证明不动产权利归属的作用。但是实践中进行不动产登记的时候,登记错误的发生在所难免,法律规定更正登记的目的就是要消除和修正出现的登记错误,其效力就是在于打破登记的公信力,确保让登记权利与真实权利的状态保持一致,因为只有这样登记制度的功能才能发挥出来。然而,我国目前更正登记制度立法上的落后,理论上的薄弱,加之实践中越来越多的登记错误的出现,影响了交易安全和当事人利益。考虑到上述问题,本文就对不动产的更正登记制度的研究更深入了一步。首先,从登记制度出发,分析了与更正登记诱因有关的登记错误的系列问题,厘清了关于更正登记以及其他登记制度的相关概念和制度差异。其次,结合中国当前实际,发现该领域中的主要问题。再次,比较其他国家和地区间不同的更正登记制度,“取其精华、去其糟粕”。最后,依据我国现实情况和各国、各地区好的做法,提出了一些完善我国更正登记制度的建议。
[Abstract]:Registration system is the means of publicizing real property right, that is to say, the change of real right is written in the books of the organs stipulated by the state. According to the provisions of the property Law of the people's Republic of China promulgated in 2007 (hereinafter referred to as "the property Law"), the carrier of property ownership and content is the register of real estate, the custody of which is the responsibility of a specific registration agency. It bears the function of proving the ownership of real estate rights. However, in practice, registration errors occur inevitably, the purpose of correcting registration is to eliminate and correct the registration errors, and its effect is to break the credibility of registration. Make sure that registration rights are consistent with the state of real rights, because only then can the registration system function. However, at present, the legislation of correction registration system in our country is backward, the theory is weak, and more registration errors appear in practice, which affect the transaction security and the interests of the parties. In view of the above problems, this paper makes a further study on the corrected registration system of real estate. First of all, from the point of view of registration system, this paper analyzes a series of problems about registration errors related to the cause of correction of registration, and clarifies the relevant concepts and system differences about corrected registration and other registration systems. Secondly, combined with China's current reality, we find the main problems in this field. Third, compare the different registration system between other countries and regions, "take the essence, discard the dross." Finally, according to the reality of our country and the good practice of all countries and regions, some suggestions are put forward to perfect the registration system of our country.
