电子竞技游戏动态画面的可版权性研究

【摘要】：电竞动态画面的性质认定是解决电竞直播法律问题的基础。电竞动态画面除游戏开发者独创设计的图形、音乐等资源外,还包括了游戏玩家的对战策略等智力成果,符合著作权法对作品的要求,应给予其著作权保护。而这种对战竞技是在电竞平台运营者的组织下进行的,将电竞动态画面定性为"以类似摄制电影的方法创作的作品"有利于实现电竞平台运营者、游戏开发者和游戏玩家三者利益的平衡。在现有法律框架下,三者的权利义务关系应以合同的方式约定。
[Abstract]:The nature of e-sports dynamic picture is the basis to solve the legal problem of e-sports live broadcast.
