我国民法典物权编立法研究

【摘要】:物权法是关于财产的所有与其物权的利用的法律,具有强制性、绝对性、对世性及严格性,关涉人民、社会及国家的根本财产利益,故此,民法典物权编的立法尤其应当谨严、审慎。于缓和物权法定原则的同时,也应持谨慎态度。物权变动规则应予维持,同时也宜吸纳司法解释的经验而予补益。在所有权上,应对所有权的定义、建筑物区分所有权中的若干规则、相邻关系规则、盗赃物、遗失物、取得时效、先占及添附等特殊动产的物权变动予以完善、厘定或确立。于用益物权上,应对用益物权的定义、"三权分置"、空间建设用地使用权、不动产役权及典权分别做出改定、明确及建构,但不宜确立居住权。于担保物权上,宜以追及效力保护抵押权人利益、让与担保不作为典型担保并对物权法第202条进行改定。此外,鉴于占有制度于物权法中的关键地位,立法还应较大地扩展、丰富占有规则。
[Abstract]:The law of real right is the law concerning all property and the use of its real right. It is mandatory, absolute, and strict to the world, and concerns the fundamental property interests of the people, society and the country. Therefore, the legislation of the real right of civil code should be especially careful. Prudence. At the same time to ease the principle of property law, we should also take a cautious attitude. The rules of alteration of real right should be maintained and supplemented by the experience of judicial interpretation. In terms of ownership, the definition of ownership, the rules of building ownership, the rules of adjacent relations, the theft of stolen property, the lost property, the limitation of acquisition, the preoccupation and attachment should be perfected, determined or established. In terms of usufruct right, the definition of usufruct right, "three rights of separation", the right to use space construction land, the right of real estate servitude and the right of pawn should be determined, defined and constructed respectively, but it is not appropriate to establish the right of residence. In the aspect of security interest, it is appropriate to protect the interests of mortgagee with the effect of pursuing, not to use the security as a typical guarantee, and to modify Article 202 of the property Law. In addition, in view of the key position of possession system in property law, legislation should be expanded to enrich possession rules.
