【摘要】：计算机网络的高速发展,让人们的生活产生了翻天覆地的变化。对于信息的传播,网络逐渐成为人们平时最常用最重要的渠道。网络媒体为了更快获得更新、更全的资讯和作品,大量进行疯狂转载。在网络媒体转载的过程中出现了大量侵犯著作权的问题,我国对网络转载适用于何种许可方式的规定几经转变,引发社会各界对此的激烈争论。本文将运用概念分析法、比较分析法和案例分析法等方法对网络转载摘编行为引起的法律问题进行分析探讨。本论文包括引言、正文和结论三个部分。其中,正文分为四章来论述。具体写作内容和思路如下:在引言部分,概括论述对网络转载摘编行为研究的必要性和重要意义,进而引出写作缘由。第一章,网络转载摘编行为的概述。笔者阐述和分析了网络转载摘编的现状以及原因,并界定了本文研究的网络转载摘编行为的客体和主体。以主要网络转载摘编涉及的作品类型为切入点为第三章中将探讨到网络转载摘编行为的性质构建框架基础。第二章,网络转载摘编著作权限制制度的立法现状。利用历史及横向比较的研究方法对有关网络转载的国际公约规定、有关国家的规定及我国有关转载摘编的规定进行了梳理、分析。为第三章网络转载、摘编行为的性质分析提供法律上的依据。第三章,网络转载、摘编行为的性质分析。这一章将从作品在网络转载、摘编之前来源的不同,分为网络转载、摘编报纸期刊作品和网络转载、摘编网络作品,就这两种行为所涉及的著作权问题进行分析论述。第四章,完善网络转载摘编行为著作权限制制度的建议。总结目前国内关于网络转载摘编法定许可方式的争论,并以此为借鉴和参考,最终提出笔者对网络转载摘编行为著作权限制制度的意见,并建议完善著作权集体管理制度。在结论部分,主要是总结研究成果,提炼本文的中心观点。
[Abstract]:With the rapid development of computer network, people's lives have changed dramatically. For the dissemination of information, the network has gradually become the most commonly used and most important channels. Network media in order to get updated faster, more complete information and works, a large number of crazy reprint. In the process of network media reprinting, a large number of copyright infringement problems have emerged, and the regulations on which network reprint is applicable in our country have changed several times, which has aroused fierce debate from all walks of life. In this paper, we will analyze the legal problems caused by the online reprinting and editing by the methods of conceptual analysis, comparative analysis and case analysis. This thesis includes three parts: introduction, text and conclusion. Among them, the text is divided into four chapters to discuss. The concrete writing content and train of thought are as follows: in the foreword part, it summarizes the necessity and significance of the research on the online reprinting and editing behavior, and then leads to the writing reason. The first chapter, the network reprint the summary of the behavior. The author expounds and analyzes the present situation and reasons of the online reprinting and cataloguing, and defines the object and the subject of the online reprint action studied in this paper. In the third chapter, the author discusses the nature of the network reprint action and constructs the framework base on the types of works involved in the main network reprint excerpts. The second chapter, the network reprint excerpts the copyright restriction system legislation present situation. By means of historical and horizontal comparison, this paper analyzes the provisions of the international conventions, the regulations of the countries concerned and the provisions of the excerpts of the reprint in China. It provides legal basis for the analysis of the nature of the third chapter. The third chapter, the network reprint, the nature analysis of the action. This chapter will be divided into network reprint, newspaper periodical works and network reprint from different sources before the works are reproduced on the network, and the copyright problems involved in these two acts will be analyzed and discussed. The fourth chapter, the suggestion of perfecting the copyright restriction system of network reprint. This paper summarizes the current domestic disputes about the legal permission method of online reprinting, and finally puts forward the author's opinions on the copyright restriction system of the online reprint and editing, and proposes to improve the collective management system of copyright. In the conclusion part, it mainly summarizes the research results and abstracts the central point of view of this paper.
