【摘要】：地理标志保护制度,同其他知识产权制度一样都是舶来品。相比于已经形成体系的其他知识产权制度,地理标志保护制度还处于不断演变与发展之中。我国历史悠久,地理标志资源丰富,不断完善和加强对于地理标志的保护十分必要。我国从加入《保护工业产权巴黎公约》后就开始了对地理标志的保护,经过多年的发展形成了我国特有的地理标志保护制度,但是现有保护制度不统一,在立法上存在漏洞、在部门职责上存在交叉和盲区、在产业管理上缺乏统一的规范。因此,在具体的法律保护中出现了一些权利冲突等现象。据此,本文将梳理我国地理标志保护的发展,分析在法律保护中出现的问题,并给出相应的对策。第一章,地理标志保护制度概述。该部分将主要从两方面来介绍,一方面,选取三个有代表性的地理标志相关概念,说明概念的由来并从中探讨其演变过程;另一方面,介绍我国的地理标志保护制度,首先以我国加入相关国际条约为时间节点介绍我国地理标志保护的发展历程,其次介绍我国现有的商标法对地理标志的保护,最后介绍我国的地理标志专门法保护制度,即质检总局与农业部管理下的两种保护体系。第二章,我国地理标志保护实践中的问题及成因分析。该章节具体介绍我国法律保护实践中的问题是在先注册商标与地理标志的冲突、注册商标与未注册地理标志的冲突以及现有保护体系间的冲突,并分析这些问题的表现、成因以及解决方案。第三章,现有法律框架内地理标志相关冲突的协调。具体的协调可以分为司法协调与行政协调。司法协调是在具体的法律实践中运用现有的法律规则和原则,主要包括保护在先权利、主观意图考察、利益平衡原则。行政协调则是从政府管理的角度阐述,主要包括建立现有体系冲突的协调机制、发挥行业协会的作用、引入第三方管理机构、申请注册阶段的审查、管理阶段的措施。
[Abstract]:The protection system of geographical indications, like other intellectual property rights system, is imported. Compared with other intellectual property systems which have formed the system, the system of geographical indication protection is still in the process of evolution and development. China has a long history and rich resources of geographical indications. It is necessary to improve and strengthen the protection of geographical indications. After joining the Paris Convention for the Protection of Industrial property, China began to protect geographical indications. After years of development, China's unique system of protection of geographical indications has been formed. However, the existing protection system is not uniform, and there are loopholes in the legislation. There are overlapping and blind areas in departmental responsibilities, and lack of uniform norms in industrial management. Therefore, in the specific legal protection there are some conflicts of rights and other phenomena. On this basis, this paper will comb the development of the protection of geographical indications in China, analyze the problems in the legal protection, and give the corresponding countermeasures. The first chapter is an overview of the protection system of geographical indications. This part will mainly introduce from two aspects, on the one hand, select three representative geographical indication related concepts, explain the origin of the concept and discuss its evolution process; on the other hand, introduce the geographical indication protection system of our country. Firstly, taking China's accession to relevant international treaties as a time node, this paper introduces the development of the protection of geographical indications in our country, then introduces the protection of geographical indications under the existing trademark law of our country, and finally introduces the protection system of the special law of geographical indications in our country. That is, the General Administration of quality Supervision and Inspection and the Ministry of Agriculture under the management of the two protection systems. The second chapter analyzes the problems and causes in the practice of geographical indication protection in China. This chapter specifically introduces the problems in the practice of legal protection in China, such as the conflicts between registered trademarks and geographical indications, the conflicts between registered trademarks and unregistered geographical indications, and the conflicts between the existing protection systems, and analyzes the performance of these problems. Causes and solutions. The third chapter, the coordination of geographical indication-related conflicts within the existing legal framework. Specific coordination can be divided into judicial coordination and administrative coordination. Judicial coordination is the application of existing legal rules and principles in specific legal practice, including the protection of prior rights, subjective intention investigation, and the principle of balance of interests. Administrative coordination is elaborated from the angle of government management, including establishing the coordination mechanism of the existing system conflict, giving play to the role of the trade association, introducing the third party management organization, applying for the examination of the registration stage, and the measures of the management stage.
