论工业产权法对侵权“山寨”产品的规制

【摘要】：“山寨”兴起于民间,以模仿为主要特征,众多“山寨”产品大行其道,形成了普遍的“山寨”现象。其中,“山寨”产品的蓬勃兴起,一方面说明了其能满足普通消费者需要,适应发展中国家的市场需求,但另一方面却暴露出我国自主创新能力的不足和知识产权观念的缺失。目前,“山寨”产品呈两极发展态势,一些“山寨”产品有所创新,另外一些则有侵权之嫌。对此,我们应区别对待,鼓励支持代表草根创新精神的“山寨”模仿,打击取缔真正的“假冒伪劣”。有效规制“山寨”产品中的侵权和不正当模仿,规范引导“山寨”模仿向自主创新转变,应从完善现有工业产权制度入手,通过制度创新来保障技术创新。本文选取了“山寨”产品制造中的模仿行为与工业产权法保护对象间的相互关系这一角度,从“山寨”产品特征、种类、侵权类型与工业产权法规制现状及完善建议等几方面论述了工业产权法对侵权“山寨”产品的规制。本文的核心部分是对“山寨”产品侵权的界定与工业产权法对“山寨”产品侵权规制的完善。笔者从具体案例入手分析讨论了“山寨”模仿与专利保护、制止不正当竞争之间的相互关系,试图厘清“山寨”产品侵权的识别判断问题,将侵权“山寨”产品从“山寨”产品中识别出来,并明确“山寨”产品侵权法律责任问题,最后通过创新文化培养和工业产权法有力约束来制止“山寨”产品侵权行为发生。本文核心部分的另一大内容是“山寨”合法产品对自主创新能力的促进作用。笔者将“山寨”产品细分为合法产品和侵权产品,其中合法产品具有创新因素,合法产品有别于侵权产品,它们对我国自主创新能力的提升具有积极意义,应区别于侵权产品进行保护和引导。本文的结论是:从“山寨”产品出现开始,“山寨”现象从经济领域蔓延至文化领域、精神领域,到如今已经发展成为一种普遍的社会现象。在“山寨”产品泛滥的今天,我们对不同“山寨”产品应持什么样的态度,这将决定“山寨”产品的未来命运。我们应理念与制度并重,不断更新观念、完善制度,通过文化培育来引导“山寨”精神在合理范围内存在,并逐渐培育出知识产权制度生存的自主创新文化土壤,同时通过制度建设来保护自主创新、合法模仿及打击侵权、不正当模仿,从而对知识产权保护与公平竞争作出进一步合理平衡。
[Abstract]:"Shanzhai" rises in the folk, with imitation as the main characteristic, numerous "shanzhai" products are popular, forming the universal phenomenon of "shanzhai". Among them, the vigorous rise of "Shanzhai" products, on the one hand, shows that it can meet the needs of ordinary consumers and meet the market needs of developing countries, but on the other hand, it exposes the lack of independent innovation ability and the lack of intellectual property rights in our country. At present, Shanzhai products show a bipolar development trend, some "Shanzhai" products are innovative, others are suspected of infringement. In this regard, we should treat it differently, encourage and support copycat imitation, which represents the innovative spirit of grassroots, and crack down on genuine "fake and shoddy." In order to regulate the infringement and improper imitation of the "Shanzhai" products effectively and guide the imitation of "shanzhai" to independent innovation, we should start with perfecting the existing industrial property right system and guarantee the technological innovation through the institutional innovation. From the angle of the relationship between the imitation behavior in the manufacture of "shanzhai" products and the objects protected by industrial property law, this paper analyzes the characteristics and types of "shanzhai" products. This paper discusses the regulation of "copycat" products by industrial property law from the aspects of the types of infringement, the current situation of industrial property law and the suggestions for improvement. The core part of this paper is the definition of "Shanzhai" product infringement and the perfection of industrial property law on the regulation of "shanzhai" product tort. The author analyzes and discusses the relationship between copycat imitation and patent protection, prevents unfair competition, and tries to clarify the problem of identifying and judging the infringement of Shanzhai products. The tort "Shanzhai" product is identified from the "shanzhai" product, and the legal liability of the "shanzhai" product is clarified. Finally, the infringement of the "shanzhai" product is prevented through the cultivation of innovative culture and the strong restraint of the industrial property law. Another major content of the core part of this paper is the promoting effect of the legal products of Shanzhai on the independent innovation ability. The author subdivides the "Shanzhai" products into legal products and infringing products, in which legal products have innovative factors, and legal products are different from tort products, which have positive significance for the promotion of independent innovation ability in China. It should be distinguished from the protection and guidance of infringing products. The conclusion of this paper is: from the emergence of "Shanzhai" products, "Shanzhai" phenomenon from the economic field to the cultural field, the spiritual field, has now developed into a general social phenomenon. With the proliferation of Shanzhai products, what kind of attitude should we hold to different shanzhai products, which will determine the future fate of shanzhai products. We should pay equal attention to the idea and the system, renew the idea constantly, perfect the system, guide the spirit of "shanzhai" to exist within a reasonable range through cultural cultivation, and gradually cultivate the independent innovation culture soil for the survival of the intellectual property system. At the same time, through the system construction to protect independent innovation, legal imitation and crack down on infringement, improper imitation, so as to make a further reasonable balance between the protection of intellectual property rights and fair competition.
