我国网络虚拟财产继承问题研究

【摘要】：随着信息网络的不断普及与发展,我国的网络用户数量越发增多,网络已经逐渐在人们的生活中变得无可或缺。而网络虚拟财产正是互联网普及和平民化的产物。网络虚拟财产中包含了网络用户的心血和劳动,具有一定的价值。但目前我国并没有相关法律对网络虚拟财产进行保护。在公民离开人世后,生前所有的虚拟财产将如何处理和继承更是没有任何明文规定。面对当前越来越多的与虚拟财产的继承相关的民事纠纷,我们不能仅仅依靠司法机关在相关方面法律空白的情况下化解争纷。在此背景下,本文基于现实出现的虚拟财产继承的案例,剖析虚拟财产继承中需要解决的问题,并对虚拟财产进行分析及研究。最后借鉴国内外相关立法及措施,针对虚拟财产继承的难点问题,为我国寻找一条适合我国虚拟财产继承的立法道路,构建一套完善的,层次分明且具有体系化的制度,化解当前这种尴尬的局面。本论文分为五个部分,主要内容如下：第一部分：提出虚拟财产继承的问题。先由现实案例引出虚拟财产的继承问题,紧接着分析了解决虚拟财产继承问题的必要性。笔者分别从从虚拟财产未来发展的需求和当前司法实践的需求等多个角度分析了解决虚拟财产继承问题的必要性,着重强调解决虚拟财产继承问题的目的所在。为下文分析虚拟财产继承问题的解决作了铺垫。第二部分：本部分主要探讨了虚拟财产的相关理论以及虚拟财产作为合法继承客体的合理性。首先从网络虚拟财产的概念入手,强调本文所讨论的是广义的虚拟财产,对虚拟财产的类型划分提出了笔者自己的建议。再对虚拟财产的法律性质进行分析,认为网络虚拟财产属于物权,可以作为合法的继承客体：从遗产的角度以及我国现行虚拟财产的相关法律法规进行分析,认为虚拟财产可以作为合法的继承客体。第三部分：分析了虚拟财产的特殊性在虚拟财产继承中所引发的难点问题。包括虚拟财产价值的评估问题、虚拟财产在继承时的分割问题、虚拟财产继承中网络服务供应商所应承担的责任与义务以及其他相关难点问题。第四部分：列举了国内外诸如美国、韩国、台湾等在网络虚拟财产继承时的立法经验和各国（地区）在处理虚拟财产继承方面的相关措施,从中分析并提出了这些立法经验和措施对我国建立网络虚拟财产继承制度可能起到的启示作用。第五部分：最后提出建立我国网络虚拟财产继承制度的几点建议。包括网络虚拟财产的价值评估、网络服务供应商在虚拟财产继承中所应有的责任与义务、网络虚拟财产继承的方式及主体、网络虚拟财产继承过程中财产分割方式与网络虚拟财产继承过程中的举证责任。总之,网络虚拟财产的继承问题是一个迫切的现实问题,并且网络虚拟财产继承问题的解决对未来网络虚拟财产的发展具有着长远意义。需要我们一步步耐心地解决好理论上与技术上的重重难题,笔者通过分析以上的问题并提出建立虚拟财产继承制度的方案,以期对我国现行继承法的的修改有所裨益。
[Abstract]:With the continuous popularization and development of the information network, the number of Internet users in our country is increasing, and the network has gradually become impossible or lacking in the people's life. And the virtual property of the network is the product of the popularization of the Internet. The virtual property of the network contains the blood and labor of the Internet users, but it has certain value. But at present, the network virtual property has certain value. There is no relevant law to protect the virtual property of the network. After the citizens leave the world, how to deal with and inherit all the virtual property will not be specified. In the face of more and more civil disputes related to the inheritance of virtual property, we can not only rely on the relevant laws of the judiciary. In this context, in this context, based on the reality of the case of virtual property inheritance, this paper analyzes the problems that need to be solved in the inheritance of virtual property, and analyzes and studies the virtual property. Finally, we draw on the relevant legislation and measures at home and abroad to find out a suitable way to solve the difficult problems of the inheritance of virtual property. In accordance with the legislative path of China's virtual property inheritance, a set of perfect, clear and systematic systems have been constructed to resolve the embarrassing situation. This paper is divided into five parts. The main contents are as follows: the first part: the issue of the inheritance of virtual property. The necessity of solving the problem of virtual property inheritance is analyzed. The author analyzes the necessity of solving the problem of inheriting virtual property from the needs of the future development of the virtual property and the demand of the current judicial practice, and emphasizes the purpose of solving the problem of inheriting the virtual property. The second part: this part mainly discusses the theory of the virtual property and the rationality of the virtual property as the legal inheritance object. First, starting with the concept of the virtual property of the network, it emphasizes the general virtual property discussed in this paper, and puts forward my own suggestions on the classification of the type of virtual property. The legal nature of virtual property is analyzed, and it is considered that the virtual property of the network belongs to the real right and can be the legal inheritance object: from the angle of heritage and the relevant laws and regulations of the current virtual property of our country, the virtual property can be regarded as the legal inheritance object. The third part is to analyze the particularity of the virtual property. The problems arising in the inheritance of virtual property include the evaluation of the value of virtual property, the problem of the segmentation of the virtual property in succession, the responsibilities and obligations of the network service providers in the inheritance of virtual property and other related difficulties. The fourth part is to list the domestic and foreign countries, such as the United States, Korea, and Taiwan, etc. The legislative experience of the network virtual property inheritance and the relevant measures of various countries (regions) in dealing with the inheritance of virtual property, analyze and put forward the implications of these legislative experiences and measures on the establishment of the system of network virtual property inheritance in China. The fifth part: finally, it puts forward the establishment of China's network of network virtual property inheritance system. It includes the value evaluation of the network virtual property, the responsibility and obligation of the network service provider in the virtual property inheritance, the way and the main body of the network virtual property inheritance, the way of property segmentation and the burden of proof in the process of the network virtual property inheritance in the process of inheriting the virtual property of the network. The inheritance of property is an urgent problem, and the solution of the network virtual property inheritance has a long-term significance for the development of the virtual property of the network. It is necessary for us to solve the theoretical and technical problems patiently and patiently. Through the analysis of the above problems and the establishment of the inheritance of the virtual property inheritance, the author proposes to establish the inheritance of virtual property. The plan of the system is intended to benefit the revision of our current inheritance law.
