论我国网购消费者后悔权制度的完善

【摘要】:消费者后悔权是指消费者与经营者双方订立了买卖合同之后,按照法律的相关规定,在一定的时间段里消费者享有的自主决定与经营者之间的合同恢复到尚未订立之时的状态,而且消费者不用向经营者说明理由,也不用因此承担赔偿或者是补偿责任。因为该权利并非是我国土生土长的法律,所以该制度在我国的出现和发展过程中势必会出现一些问题,尤其是在当下这个网络购物如此普及的时代,因此对于消费者在远程购物当中可能会出现的问题值得讨论和进一步的研究。本文分为四章来论述我国网购消费者后悔权制度的完善,第一章是网购消费者后悔权制度的概述,通过与《合同法》中的撤销权以及解除权做比较,进一步的突出消费者后悔权的特征:单方性、法定性和无因性。第二章是介绍域外关于消费者后悔权制度的相关规定,主要是介绍英国、美国和德国这三个发达国家在消费者后悔权制度的起算点、权利的行使期限、行使的法律后果等。第三章是我国消费者后悔权制度的现状及存在的问题,首先,介绍了我国消费者后悔权制度的发展过程,其次分析我国消费者后悔权制度设计的合理性,最后通过与第二章介绍的发达国家的相关规定,比较得出我国消费者后悔权制度存在的问题。第四章是我国消费者后悔权制度的完善,对于域外的相关规定进行借鉴基础上提出了进一步完善的建议:完善相关法律制度,适用范围进一步扩大,将服务纳入消费者后悔权制度,完善权利的行使期间,将权利的起算点与经营者的告知义务相挂钩;加大监管的力度,加强行业和行政的监管;健全司法救济机制,发展在线纠纷解决机制,提高办事的效率;加大法治宣传教育,使得消费者真正的学会运用法律来保护自己的权利同时也要规范自己的行为。
[Abstract]:The right of consumer repentance refers to the state in which the contract between the consumer and the operator is restored to the time when the contract between the consumer and the operator has not been concluded in accordance with the relevant provisions of the law, and the contract between the consumer and the operator is restored to a certain period of time after the conclusion of the contract. And consumers do not have to explain reasons to the operator, do not assume compensation or liability for compensation. Because this right is not a native law of our country, there are bound to be some problems in the emergence and development of this system in our country, especially in the current era when online shopping is so popular. Therefore, it is worth discussing and further studying the problems that the consumers may appear in the distance shopping. This paper is divided into four chapters to discuss the perfection of the system of repentance right of online shopping consumers in our country. The first chapter is an overview of the system of repentance right of online shopping consumers, which is compared with the revocation right and rescission right in contract Law. Further highlight the characteristics of consumer rights of regret: unilateral, legal and non-cause. The second chapter is to introduce the relevant provisions of the system of consumer repentance, mainly introduces the UK, the United States and Germany, the three developed countries in the consumer regret system of the starting point, the exercise of rights, the legal consequences of the exercise. The third chapter is the current situation and existing problems of the consumer regret right system in our country. Firstly, it introduces the development process of the consumer regret right system in our country, and then analyzes the rationality of the design of the consumer regret right system in our country. Finally, by comparing with the relevant regulations of developed countries introduced in the second chapter, the author draws the conclusion that there are problems in the system of consumer repentance in our country. The fourth chapter is the consummation of the system of consumer's right of regret in our country. On the basis of reference to the relevant provisions of foreign countries, the author puts forward some suggestions: to perfect the relevant legal system, to expand the scope of application, Bring the service into the consumer repentance system, perfect the exercise of the right, link the starting point of the right with the operator's duty of informing, strengthen the supervision, strengthen the supervision of the industry and administration, perfect the judicial relief mechanism, Develop online dispute resolution mechanism to improve the efficiency of work; increase the rule of law publicity and education, so that consumers really learn to use the law to protect their rights, but also to regulate their own behavior.
