作品完整权的保护限度

【摘要】：作品完整权的保护限度是什么?这是本文关注并试图回答的主题。对作品完整权保护的要旨,不在于作品本身,也不在于公众的审美利益,而是作者本人的利益。保护作品完整权的认定标准不一,司法实践中有主观标准和客观标准。主观标准主要考虑对作品的修改是否违背作者的主观意图,客观标准主要考虑作者声誉是否受到损害。比较合理的认定标准,在于修改是否违背了作者的思想。
[Abstract]:What are the limits of protection of the right to integrity of a work? This is the topic this article focuses on and tries to answer. The essence of the protection of the right to the integrity of works lies not in the works themselves, nor in the aesthetic interests of the public, but in the interests of the author himself. In judicial practice, there are subjective and objective standards for the protection of the right to integrity of works. The subjective criterion mainly considers whether the modification of the work is contrary to the author's subjective intention, and the objective criterion mainly considers whether the author's reputation is damaged. A more reasonable standard of identification lies in whether the modification violates the author's ideas.
