职务发明创造的专利权属问题探析

【摘要】：随着我国经济发展水平的提高,职务发明创造在发明创造中所占的比例不断攀升,我国的职务发明创造的专利权属制度受到了新的挑战。本文从我国司法实践出发,对比其他国家的相关规定,以我国目前的社会经济发展水平为基础,提出进一步完善我国职务发明创造的专利权属制度的建议。
[Abstract]:With the improvement of our country's economic development level, the proportion of the job invention and creation in the invention and creation is increasing, and the patent right system of the duty invention and creation in our country has been confronted with new challenges. Starting from the judicial practice of our country and comparing with the relevant regulations of other countries, this paper puts forward some suggestions for further perfecting the patent right system of duty invention and creation in our country, based on the current level of social and economic development in our country.
