标的物检验制度的不足与完善

【摘要】：民法典的编纂涉及各方面的问题,在交易方式和交易关系日新月异的今天,标的物检验问题尚未得到足够的关注和研究,对于标的物检验制度存在的不足,需要在制定《中华人民共和国民法典·合同编》时进一步完善。本文结合典型案例,分析讨论了标的物检验主体与检验资质问题、检验依据问题、检验地点问题、检验结论的效力问题、第三方检验主体的责任问题等,提出了完善标的物检验制度的对策。
[Abstract]:The compilation of the Civil Code involves various problems. Nowadays, the subject matter inspection problem has not been paid enough attention and studied, and there are some deficiencies in the subject matter inspection system. It needs to be further improved in the formulation of the contract compilation of the Civil Code of the people's Republic of China. Combined with typical cases, this paper analyzes and discusses the subject matter inspection subject and qualification, inspection basis, inspection location, validity of inspection conclusion, liability of third party inspection subject, etc. The countermeasures to perfect the inspection system of the subject matter are put forward.
