论建筑物区分所有权之共有权

【摘要】:随着现代建筑业的迅速发展和城镇化速度的不断加快,建筑面积的增长需求与土地面积的有限性之间的矛盾越来越突出,传统建筑的独立性逐渐被打破,高空化、多层化和单元化逐渐成为建筑业的发展趋势,建筑物区分所有权制度应运而生,并成为各国家和地区民法体系上的一项重要制度。根据通说,建筑物区分所有权是一种复合型权利,由共有权、专有权和成员权三部分组成。其中,,建筑物区分所有权之共有权这一“物法性”要素又是构成建筑物区分所有权制度的“共同性灵魂”,在建筑物区分所有权制度中居于核心地位,对其进行研究不仅有助于完善我国的建筑物区分所有权制度,也有利于实践中相关问题的解决。 本文以现实生活中的实际案例为引,首先对建筑物区分所有权制度的基本理论进行了简单介绍,并在此基础上对共有权的性质、共用部分的范围、共有权的使用等学界争论的热点问题进行了相关分析,提出了在共有权之上设立专有使用权的设想,最后对小区停车位、绿地、屋顶平台等特殊共用部分的权利归属问题进行了分析并提出了相应的解决建议。
[Abstract]:With the rapid development of modern construction industry and the acceleration of urbanization, the contradiction between the increasing demand of building area and the limitation of land area is becoming more and more prominent. Multi-layer and unit gradually become the development trend of the construction industry. The system of building differentiated ownership emerges as the times require and becomes an important system in the civil law system of various countries and regions. According to the general theory, building ownership is a kind of compound right, which consists of three parts: common right, exclusive right and member right. Among them, the co-ownership of building condominium is the "common soul" which constitutes the system of building ownership, and occupies the core position in the system of building condominium ownership. The research is not only helpful to perfect the system of building condominium ownership, but also helpful to solve the related problems in practice. Based on the actual cases in real life, this paper first introduces the basic theory of building ownership system, and on the basis of this, the nature of the common right, the scope of the common part, The use of co-ownership and other controversial hot issues are analyzed, and the idea of establishing exclusive right of use on the basis of co-ownership is put forward. Finally, parking spaces and green spaces in residential areas are given. The ownership of special common parts such as roof platform is analyzed and the corresponding solutions are put forward.
