雇主替代责任法律问题研究

【摘要】:由于市场准入机制的放宽,雇员提供劳务和技术服务已经成为一种常态。在劳动力市场化的今天,越来越多的人加入到雇员的行列中,成为雇佣关系链条之中的一员。在雇佣关系存续期间,雇员因执行受雇事务侵权造成第三人损害的情况屡屡可见,因此如何协调雇主、雇员和受损第三人之间利益的问题就显得尤为重要。但是,纵观我国现行的法律规定,能对此问题予以规范和调整的成文法条并不多,这既给目前我国司法实践对相关责任的认定带来了困难和混乱,也使得对雇主替代责任的研究有更广阔的空间和前景。基于此,本文笔者希望通过对我国现行法的分析,提出完善雇主替代责任制度的建议,以更好的发挥该制度的优势。全文共分为五个部分: 第一部分:雇主替代责任概述。首先对雇主替代责任的概念进行介绍,其次分析雇主替代责任的特征和法律性质,并对雇主替代责任的发展简史进行梳理。 第二部分:介绍国外有关国家雇主替代责任制度的归责原则,比较分析我国在雇主替代责任上的无过错归责原则。 第三部分:本部分主要着重从雇佣关系、受雇事务、侵权行为及受损事实这四个方面,厘清雇主替代责任的构成要件。对雇主替代责任从内外责任的承担方面加以区分,对外责任以雇主为义务主体,内部责任以雇员为最终承担人。 第四部分:对我国关于雇主替代责任制度的现存法律规范进行分析,探讨其存在的不足。 第五部分:针对现行法律规范中存在的问题,提出完善建议。
[Abstract]:Due to the relaxation of market access mechanism, the provision of labor and technical services by employees has become the norm. In the labor market today, more and more people join the ranks of employees and become a member of the chain of employment relations. During the existence of employment relationship, it is common for employees to cause damage to the third party because of the infringement of employment affairs. Therefore, how to coordinate the interests of employers, employees and injured third parties is particularly important. However, looking at the current legal provisions of our country, there are not many statutory laws that can regulate and adjust this problem, which has brought difficulties and confusion to the determination of relevant responsibilities in the current judicial practice of our country. It also makes the study of employer substitution liability have a broader space and prospects. Based on this, the author hopes that through the analysis of the current law of our country, the author puts forward some suggestions to perfect the employer's substitute liability system, so as to bring the advantages of the system into full play. The paper is divided into five parts: the first part: the summary of employer's alternative liability. Firstly, the concept of employer's substitute liability is introduced, then the characteristics and legal nature of employer's substitute liability are analyzed, and the development history of employer's substitute liability is combed out. In the second part, the author introduces the principles of liability attribution in foreign countries, and compares and analyzes the principle of no-fault liability in our country. The third part: this part mainly from the employment relations, the employment affairs, the tort and the damage fact these four aspects, clarifies the employer substitution responsibility constituent elements. The substitute liability of employer is distinguished from the assumption of internal and external responsibility. The external liability is the employer as the subject of obligation, and the internal responsibility is the employee as the ultimate responsible person. The fourth part analyzes the existing legal norms of the employer's substitute liability system in China and discusses its shortcomings. The fifth part: in view of the existing problems in the existing legal norms, put forward some suggestions.
