影响现代著作权保护制度确立的因素——以中西方著作权法产生为视角的分析

【摘要】：在现代著作权保护制度确立之前,随着最早发明于中国的印刷术的采用,中西方国家都曾出现过规范书籍出版和传播的特殊管理制度。但是,为什么著作权法律制度首先在西方国家确立,而中国却直至清末才在国际压力下被动地制定了历史上第一部著作权法?致使中西方的著作权保护立法相差了近二百年的时间。追寻历史和比较分析可以发现,影响著作权保护制度确立的原因可以归结为五大因素,其中,言论自由和出版商对自身利益的争取是最主要的直接原因,而当时的政治制度、经济发展水平和先进思想理论传播则是重要的基础性因素。
[Abstract]:Before the establishment of the modern copyright protection system, with the adoption of the earliest invention of printing in China, there had been a special management system to regulate the publication and dissemination of books in the western countries. However, the legal system of copyright was first established in the western countries, and China was passively developed under international pressure until the end of the Qing Dynasty. The first copyright law in history has resulted in the difference between Chinese and Western copyright protection legislation for nearly two hundred years. The pursuit of history and comparative analysis can be found that the reasons for the establishment of the copyright protection system can be attributed to five major factors, of which the freedom of speech and the publisher's struggle for their own interests are the main direct causes. At that time, the political system, the level of economic development and the dissemination of advanced ideas and theories were important basic factors.
