惩罚性赔偿制度的价值选择模型

【摘要】：本文立足惩罚性赔偿制度实施的现状,寻求民商事领域、经济活动中普遍存在的侵权行为所带来的私权利救济问题之路径。通过检视惩罚性赔偿制度的权益分配、价值选择和表现形式,分析惩罚性赔偿制度和附带惩罚性赔偿制度价值选择模型的混合式行政性惩罚制度二者在填补民商事权益救济漏洞上的可能性,归纳、比较二者存在的价值选择上的同一性及该同一性的依据、特点、效用,借鉴法的经济分析科学来推演、设计相应的价值选择模型;进而思索法制价值选择驳乱或缺失的商事难题、经济热点等现实问题,清厘热门规范的混沌价值、纠正疑难案例的价值错位,回归于惩罚性赔偿制度的价值选择模型之大量实践,以应对社会现实中的各类民商事权益、经济利益救济不周、救济不利、救济不能之急需。
[Abstract]:Based on the current situation of the implementation of punitive damages system, this paper seeks the path of private right relief caused by the widespread tort in the field of civil and commercial affairs and economic activities. By examining the distribution of rights and interests, the choice of value and the forms of expression of the punitive damages system, This paper analyzes the possibility of the punitive damages system and the mixed administrative punishment system with the value choice model of the punitive damages system in filling the loopholes in the relief of civil and commercial rights and interests. Comparing the identity of value selection between them and the basis, characteristics and utility of the identity, using the economic analysis science of the method for reference to deduce and design the corresponding value selection model; Then consider the value of the legal system to choose refuted or missing commercial problems, economic hot spots and other practical issues, clear the chaotic value of popular norms, correct the value of difficult cases of misplacement, In order to deal with various kinds of civil and commercial rights and interests in the social reality, the economic benefit relief is inadequate, the remedy is unfavorable, and the relief cannot be urgently needed.
