论物权请求权的性质

【摘要】：我国《物权法》没有对物权请求权是否适用诉讼时效做出明确规定,学界、审批实践领域对此问题争议颇多,产生争议的原因主要在于对物权请求权性质的不同认定。物权请求权产生于《德国民法典》,而这一概念并没有在《法国民法典》中出现,其原因在于后者不承认物权行为无因性。物权行为无因性是物、债二分体系的必然结果。讨论我国物权请求权的性质之前要明晰我国《物权法》对于物权行为无因性的态度,然后从物、债二分的角度分析其性质,这对于物权体系乃至主观权利体系的认识具有重要意义。
[Abstract]:There is no clear stipulation on whether the right of claim in real right is applicable to the limitation of action in our country. There are many disputes in the field of examination and approval. The main reason for the dispute lies in the different recognition of the nature of the right of claim in real right. The claim of real right arises from the German Civil Code, but this concept does not appear in the French Civil Code, the reason is that the latter does not admit that the act of real right has no cause. The non-causality of the act of real right is the inevitable result of the dual system of material and debt. Before discussing the nature of the right of claim of real right in our country, we should make clear the attitude of our country's property law to the property right act without cause, and then analyze its nature from the angle of the dual division of property and debt. This is of great significance to the understanding of real right system and even subjective right system.
