加强物业服务行业监管的问题分析

【摘要】:当前要求加强物业服务行业监管的呼声此起彼伏,这不仅是行业自律的要求,也是百姓的诉求,而且许多城市已将加强物业服务行业的监管提到了政府工作的日程上来了。从监管的对象、监管的定位、监管的难点、监管的重点等几个方面入手,依据《物权法》、《物业管理条例》等法律法规,针对目前监管物业管理中出现的问题进行了分析,并提出了以下观点:监管应针对物业管理市场相关各方主体,而不应只针对物业公司;监管应维护物业管理市场交易的公平,而不是以行政意志加重企业的负担;摆脱重走政府包办的老路,创造性地走出一条通过市场机制来调节、解决市场问题的新路;依法监管,理顺、创新和建立物业管理市场制度。
[Abstract]:At present, there are calls to strengthen the supervision of property service industry. This is not only the demand of industry self-discipline, but also the demand of the common people, and many cities have put the supervision of property service industry on the agenda of government work. Starting with the object of supervision, the orientation of supervision, the difficulty of supervision, the emphasis of supervision and so on, according to the laws and regulations such as Real right Law and property Management regulations, this paper analyzes the problems existing in the current supervision of property management. The author also puts forward the following points: supervision should be directed at the parties concerned in the property management market, not only at the property companies, but also on the fairness of the transactions in the property management market, not on the administrative will to increase the burden on the enterprises; To get rid of the old road of government arrangement, to creatively step out a new way to adjust and solve the market problems through market mechanism, and to supervise, rationalize, innovate and establish the market system of property management according to law.
