社区养老的法律规制问题研究

【摘要】：养老涉及到每个人晚年生活的品质,因此而备受大家关注。由于计划生育政策改变了原有的家庭结构再加上工业化浪潮的影响,家庭养老功能逐渐弱化,机构养老由于高昂的收费也使得许多老人望而却步,此时,社区养老以其成本低,服务内容丰富,利用率高,功能全等成为一种新兴的热门养老服务。本文立足于我国未富先老的时代大背景下,始终以更好地实现老人的养老权为宗旨。为了更好地把握社区养老的本质内涵首先阐述了社区养老的基本理论,其次从我国社区养老的现行法律规范着手,找出其中存在的问题,最后通过国外相关内容的研究对我国社区养老法律规范提出几点完善建议。全文共分为四部分:第一部分社区养老的基本理论和发展现状。主要包括社区养老的理论基础、理论渊源和发展现状三方面内容。理论基础主要阐述了社区养老的含义、特征和权利基础;社区养老的理论渊源是从社会嵌入理论、社会福利多元主义和需求层次理论进行陈述。上述内容共同构成了社区养老的理论支撑。社区养老的发展现状分析了在发展过程中存在的问题及成因分析。第二部分着重从成因中相关法律规范的角度考察,分析了社区养老机构的市场准入、退出机制,社区养老服务标准,社区养老合同,社区养老的监管等方面存在的问题。第三部分国外社区养老法律规制研究。通过对英美法系中英国、美国、澳大利亚社区养老的相关法律规范和大陆法系中德国和日本社区养老的法律规范进行研究,并获得相应的启示。第四部分社区养老法律规范的完善建议。对上述我国社区养老法律规范存在的问题,结合国外的经验启示,逐一提出符合我国基本国情的完善建议。
[Abstract]:Old-age care involves the quality of each person's life in old age, so it has attracted much attention. Because the family planning policy has changed the original family structure and the influence of the industrialization tide, the family pension function has been weakened gradually, the institution old-age care has also made many old people put off because of the high charge. At this time, the community old-age care is low in cost. The service content is rich, the utilization rate is high, the function all becomes one kind of new popular pension service. This paper is based on the background of the old age before we get rich, and always aims at realizing the right of the aged better. In order to better grasp the essential connotation of community old-age care, this paper first expounds the basic theory of community old-age support, and then starts with the current legal norms of community old-age support in China, and finds out the existing problems. Finally, through the study of the relevant contents of foreign countries, some suggestions are put forward to improve the legal norms of community pension in our country. The paper is divided into four parts: the first part is the basic theory and development of community pension. Mainly includes the community endowment theory foundation, the theory origin and the development present situation three aspects content. The theoretical basis mainly expounds the meaning, characteristics and right basis of community old-age support, and the theoretical origin of community old-age support is stated from the theory of social embedding, social welfare pluralism and the theory of hierarchy of needs. The above contents together constitute the theoretical support of community pension. This paper analyzes the problems and causes of the development of community pension. The second part focuses on the causes of the relevant legal norms from the perspective of the analysis of community pension institutions market access, withdrawal mechanism, community pension service standards, community pension contracts, community pension supervision and other aspects of the problems. The third part studies the legal regulation of community pension in foreign countries. This paper studies the relevant legal norms of community pension in Anglo-American law system, the United States and Australia, and the legal norms of community pension in Germany and Japan in the continental law system, and obtains the corresponding enlightenment. The fourth part is the suggestion of perfecting the legal norm of community pension. On the basis of the above problems in the legal norms of community pension in our country and the enlightenment of foreign experiences, the author puts forward some suggestions to perfect them one by one in accordance with the basic national conditions of our country.
