快递服务损害赔偿责任研究

【摘要】：快递服务已经遍及社会日常生活的方方面面,在给人们带来越来越多的便利和实惠的同时,有些快递服务行为侵犯了消费者的合法权益,在一定程度上给人们带来了一些烦恼、争议甚至纠纷。本文较系统地通过对快递服务损害赔偿责任的基本问题的厘定和分析,进一步对快递服务损害赔偿责任中留存的现状问题加以梳理和研习,对快递服务损害赔偿责任性质加以论述和分析,对快递服务损害赔偿责任法律适用问题加以研究和探讨,以整合快递服务损害赔偿现行法律法规为前提,通过引入“举证责任倒置”原则、完善快递保价制度、建立快递保险机制、健全验视与签收制度等几个角度的措施,以期使快递服务损害赔偿责任的立法现状得以改善,最大限度地保护消费者在快递服务中的合法权益。
[Abstract]:Express delivery service has spread all aspects of the daily life of the society. The more convenient and affordable it is, the more convenient and affordable it is. At the same time, some express service acts have infringed on the legitimate rights and interests of consumers, and to a certain extent have brought some troubles to people. Disputes and even disputes. Through the determination and analysis of the basic problems of the liability for damages of express delivery service, this paper further combs and studies the existing problems in the liability for damages of express service. This paper discusses and analyzes the nature of the liability for damages of express delivery service, studies and discusses the legal application of the liability for damages of express service, and takes the conformity of the existing laws and regulations of the damage compensation for express service as the premise. By introducing the principle of "inversion of the burden of proof", perfecting the system of courier insurance, establishing the mechanism of express delivery insurance, perfecting the inspection and acceptance system, and so on, the author hopes to improve the present legislative situation of the liability for damages of express delivery service. To maximize the protection of consumers in the legal rights and interests of express services.
