浅析区分所有建筑物专有部分与共有部分的判断标准

【摘要】:随着城市化的不断推进,大量人口涌入城市,加之大量高层甚至超高层建筑物不断出现,多个当事人对同一建筑物区分所有成为常态,建筑物区分所有权制度逐渐为我国理论及实务界所关注,进而在我国《物权法》中得以确立。然而,我国物权法构建的建筑物区分所有权制度仍无法解决实务中关注的许多问题,例如,实务中争议较大的停车位权属问题,还有会所、屋顶平台、外墙面等建筑的权属问题。笔者认为,这些争议均是围绕着建筑物区分所有权专有部分与共有部分的界定而展开的,对于这一问题学者们虽然在理论上做过探讨,但始终都无法提供有效解决该问题的办法,因而,笔者选取“浅析区分所有权建筑物专有部分与共有部分的判断依据”这一题目,对建筑物区分所有权中专有部分与共有部分的判断依据进行分析探讨。本文的研究思路是首先对建筑物区分所有权制度的相关理论进行阐释,分析我国建筑物区分所有权制度存在的问题,接下来对域外国家和地区确立的区分所有建筑物专有部分和共有部分判断标准进行考察分析,总结归纳出一套系统合理的专有部分和共有部分判断标准,为界定区分所有建筑物专有部分和共有部分的范围提供依据。另外本文还会利用总结出的判断依据对实践中存在争议的停车位、屋顶平台、外墙面问题进行具体分析。
[Abstract]:With the continuous development of urbanization, a large number of people poured into the city, coupled with a large number of high-rise or even super-tall buildings continue to appear, many parties to distinguish the same building all become the normal, The system of building condominium ownership has been paid more and more attention in theory and practice of our country, and it has been established in the Real right Law of our country. However, the building condominium system constructed by the real right law of our country can not solve many problems concerned in practice, for example, the controversial ownership of parking spaces in practice, as well as clubhouse and roof platform. The ownership of buildings such as external walls. The author believes that these disputes all revolve around the definition of the exclusive part and the common part of the ownership of the building, although the scholars have made a theoretical discussion on this issue. However, it is impossible to provide an effective solution to this problem. Therefore, the author chooses the topic of "analyzing the judgment basis of the exclusive part and the common part of the differentiated ownership building". This paper analyzes and discusses the judgment basis of the secondary and common parts of building ownership. The research idea of this paper is to explain the relevant theories of the building division ownership system, and analyze the existing problems of the building division ownership system in our country. Then, the criteria for distinguishing exclusive and common parts of all buildings established by foreign countries and regions are investigated and analyzed, and a set of systematic and reasonable judgment criteria for exclusive and common parts are summarized and concluded. Provides the basis for defining the scope that distinguishes the exclusive and common parts of all buildings. In addition, this paper will use the summarized judgment basis to analyze the controversial parking space, roof platform and exterior wall.
