论网购消费者知情权保护
[Abstract]:With the development of the Internet, online shopping has become a new type of consumption. Online shopping has virtual, technical and off-site, consumers can not directly contact goods or services. Online shopping consumer for goods or services mainly depends on the operator's text, pictures and other information. Compared with the traditional shopping mode, the realization of consumers' right to know depends more on the implementation of the operator's obligation to inform. The current social credit system is not perfect, online shopping operators in order to obtain more profits, consumer fraud is very common. Online shopping operators publish network false advertising, false publicity and credit fraud is very common. Online shopping consumers' right to know than traditional transactions are more vulnerable to infringement. The current research on online shopping in our country is in the initial stage. The situation that the consumers' right to know is not protected enough and the consumers' right to know is infringed is common. At present, the protection of consumers' right to know is a subject worth studying. This paper uses the methods of theoretical analysis, empirical analysis and comparative analysis to analyze the existing problems and reasons of the protection of online shopping consumers' right to know, starting from the current situation of the protection of consumers' right to know online shopping in China, taking the right to know of online shopping consumers as the core. Using foreign legislative experience for reference, this paper explores how to further improve the protection system of the right to know of online shopping consumers in our country. This paper is divided into four chapters. The first chapter describes the right to know about online shopping consumers. This paper discusses the concept content of consumers' right to know and the content of consumers' right to know online, and expounds the particularity of consumers' right to know and the necessity of protection. To lay the foundation for the following research. The second chapter expounds the current situation of the protection of the right to know for consumers. Through discussing the compulsory regulation of information disclosure obligation of online shopping operator in our country's law, strengthening the responsibility of protecting consumers' right to know on the online shopping platform and giving consumers the right to withdraw to make up for the obstruction of the realization of the right to know in the environment of online purchase, this paper discusses three aspects: Comprehensive analysis of the current law of China how to protect the right to know online shopping consumers. The third chapter expounds the problems existing in the protection of consumers' right to know online shopping. Including online shopping operators do not fulfill the obligation to inform, online shopping consumers' right to know the right to protect their rights channels and withdraw the right to adapt to the difficulties and disputes of these three parts. By analyzing the causes of these problems, this paper lays a foundation for the following protection measures. The fourth chapter elaborated the suggestion which consummates the online shopping consumer to know the right to know the protection. It includes four parts: perfecting the information disclosure system of online shopping operators, perfecting the mechanism of protecting consumers' right to know, perfecting the legal provisions of the protection of online shopping consumers' right to know, and strengthening the supervision and punishment of online sales of fake and fraud.
