互联网环境下体育赛事转播的法律保护研究

【摘要】：随着时代的进步发展,人们对于娱乐活动的需求越来越大,而体育赛事作为娱乐活动重要的一块,自然受到广大群众的喜爱和关注。体育赛事转播成为体育产业经济效益的重要来源。体育赛事商业化、职业化、专业化成为必然趋势。再加上现在互联网技术和信息技术的不断进步,“互联网+体育”模式成为了体育产业推广的重要方式。近几年来,对于体育赛事转播,特别是体育赛事网络转播,人们的关注度越来越高。但随之而来的,体育赛事转播侵权事件越来越多,方式也多种多样。而我国现有的法律体系中没有专门针对体育赛事转播的法律条文,在此种情况下,当出现体育赛事转播侵权案件时,各地法院法官难以找到明确的法律依据,导致出现相同案件不同判决的尴尬情况发生,这对于我国体育产业的发展以及法制的发展,都是极其不利的。完善我国体育赛事转播法律保护制度是我国现阶段非常急迫的需求。国外对于体育赛事转播的研究已经有了一定的成果,像美国,已经有一套行之有效的体育赛事转播法律保护制度。当然鉴于各个国家的文化、法系的不同,我国当然不能完全移植他国的法律法规,但是不妨碍我们可以借鉴他国的规定。我国在体育赛事转播保护方面,特别是体育赛事网络转播方面,尚存在很多的不足,主要表现在体育赛事转播权益不明,体育赛事节目的法律属性尚有争议,以及《著作权法》中信息网络传播权和广播权的管辖范围太过狭窄等。为此,本文试图通过比较分析国内外关于体育赛事转播法律性质相关学说理论,阐述个人对于体育赛事转播法律属性的看法,同时依据现阶段互联网环境下我国主要的体育赛事转播侵权类型,总结并分析我国现行相关方面法律法规的漏洞,借鉴国外相关司法实践和法规,提出完善体育赛事转播法律保护制度的建议。本文共分为三部分,第一部分是体育赛事转播的法律属性概述,本文首先明确了体育赛事转播的含义和发展概括,并且阐述网络环境对体育赛事转播的影响。另外,第一部分对于体育赛事和体育赛事节目的法律属性进行了分析,结合国内外对于体育赛事转播相关理论学说,表明本文作者对于体育赛事转播权益来源的看法。第二部分是国内外体育赛事网络转播的法律规定,首先是介绍了欧盟等国家的体育赛事网络转播方面的法律法规和做法,其次通过总结我国现阶段体育赛事网络转播侵权的类型,分析我国现行相关法律法规的现状和不足。最后一部分,提出完善我国体育赛事转播法律保护制度的建议,主要包括:明确体育赛事转播权法律地位;确定体育赛事节目的版权性;创设向公众传播权;规范体育赛事转播合同;明确反不当竞争法的保护。
[Abstract]:With the development of the times, people need more and more entertainment activities, and sports events, as an important part of entertainment activities, are naturally loved and concerned by the masses. Sports event broadcasting has become an important source of economic benefits of sports industry. The commercialization, professionalization and specialization of sports events have become an inevitable trend. In addition, with the continuous progress of Internet technology and information technology, the mode of "Internet Sports" has become an important way to promote the sports industry. In recent years, people pay more and more attention to the broadcast of sports events, especially the network broadcasting of sports events. But then, the sports event broadcast infringement events more and more, the way is also various. However, the existing legal system of our country does not have any specific legal provisions for the broadcasting of sports events. In this case, when there are infringement cases of sports events, it is difficult for local court judges to find a clear legal basis. It is very unfavorable to the development of sports industry and the development of legal system. It is urgent to perfect the legal protection system of sports event relay in our country. There have been some achievements in the research of sports event broadcasting abroad, such as the United States, there has been an effective system of legal protection of sports event broadcasting. Of course, in view of the different cultures and legal systems of different countries, our country can not transplant the laws and regulations of other countries completely, but it does not prevent us from drawing lessons from the regulations of other countries. In our country, there are still many deficiencies in the protection of the relay of sports events, especially in the network broadcasting of sports events, mainly in the unclear rights and interests of the broadcasting of sports events, the legal attributes of sports events are still controversial, And the jurisdiction of the right of information transmission and broadcasting in copyright Law is too narrow. For this reason, this paper attempts to explain the personal views on the legal attributes of sports events broadcasting by comparing and analyzing domestic and foreign theories about the legal nature of sports events broadcasting. At the same time, according to the main infringement types of sports events broadcast in the current Internet environment, this paper summarizes and analyzes the loopholes of the relevant laws and regulations of our country, and draws lessons from the relevant judicial practices and regulations of foreign countries. Put forward the suggestion of perfecting the legal protection system of sports event broadcasting. This paper is divided into three parts. The first part is an overview of the legal attributes of sports events broadcast. Firstly, this paper clarifies the meaning and development of sports events broadcasting, and expounds the impact of network environment on sports events broadcast. In addition, the first part of the analysis of the legal attributes of sports events and sports events programs, combined with the relevant theory of sports events broadcasting theory, show that the author of this article about the rights and interests of sports events of the source of views. The second part is the domestic and foreign sports events network broadcast laws and regulations, first of all, introduced the European Union and other countries sports events network broadcasting laws, regulations and practices, Secondly, by summing up the types of network relay infringement of sports events in our country, this paper analyzes the current situation and deficiency of relevant laws and regulations in our country. In the last part, the author puts forward some suggestions to perfect the legal protection system of sports event broadcasting in China, including: clarifying the legal status of sports event broadcasting right; determining the copyright of sports event program; creating the right to communicate to the public; To standardize the contract of broadcasting sports events; to make clear the protection of the anti-improper competition law.
