论商标权的边界

【摘要】：商标法授予商标权的目的在于促进本国产业发展,因而确定商标权的边界时必须严格坚持商标权地域性原则;在申请商标注册程序或者注册商标争议程序中,商标审查机关应当通过严格解释商标的近似性以防止不适当扩张商标权的边界;司法机关则必须通过在特定条件下对商标权人的停止侵害请求权进行限制的方式,削弱甚至消解商标权的排他性。
[Abstract]:The purpose of trademark law to grant trademark right is to promote the development of national industry, so the regional principle of trademark right must be strictly adhered to when determining the boundary of trademark right. In the procedure of applying for trademark registration or in the procedure of trademark dispute registration, the trademark examination organ shall strictly interpret the similarity of the trademark in order to prevent the improper expansion of the boundary of trademark rights; On the other hand, the judicial organ must restrict the trademark owner's right to stop infringing on the claim under certain conditions, so as to weaken or even eliminate the exclusiveness of trademark right.
