论新生权利的创设--以“冷冻胚胎案”中监管权与处置权的创设为例

【摘要】：从利益到权利的过渡,即权利的创设。关于怎样合理把握权利创设的基本问题,学界曾争论激烈,但至今未能达成共识。发生在江苏无锡的"冷冻胚胎案"历经先后两次不同的判决,使人们认识到准确把握权利创设标准的紧迫性和必要性。哲学上,对权力要素的把握分为"五要素说"和"十要素说",通过"五要素说"对权利创设依据进行分析更具合理性。目前,对于新生权利不宜进行立法创设,司法创设也应更具谨慎与理性。
[Abstract]:The transition from interests to rights is the creation of rights. There has been a heated debate on how to reasonably grasp the creation of rights, but no consensus has been reached so far. The "frozen embryo case" in Wuxi, Jiangsu Province, has undergone two different judgments, which makes people realize the urgency and necessity of accurately grasping the standard of right creation. In philosophy, the grasp of power elements can be divided into five elements theory and ten elements theory, and it is more reasonable to analyze the basis of right creation through the five elements theory. At present, new rights should not be created by legislation, and judicial creation should be more cautious and rational.
