【摘要】：同样的设计,不同知识产权类型对其保护不同。一项好设计自产生之日起就能获得著作权的保护,在符合相关法律规定要求的情形下,还可以同时申请商标权和外观设计专利权。同样的设计,采用不同的形式申请商标和专利权,其保护范围也不同。
