我国医疗责任鉴定机构的法律问题研究

【摘要】：当前,在双轨制的医疗责任鉴定机构的形势下,各医疗责任鉴定机构都在为化解医疗纠纷而服务。然而,两种鉴定机构由于在设立、职责、治理结构等方面的界限存在模糊,导致鉴定意见出现矛盾问题,困扰着纠纷的解决和鉴定意见的权威和效力。对于这些存在的问题,从分析当前双轨制的鉴定机构及其存在的问题、域外鉴定制度的发展状况着手,提出了要完善医疗责任鉴定机构的设想,即建立一元化的统一医疗责任鉴定机构。为科学规范、统一管理,在设立鉴定机构方面,建立一个医疗责任鉴定机构,变双轨为单轨,这就要求配备合格的鉴定人员;在规范鉴定机构的程序上,应规范鉴定的启动程序,公开鉴定过程;在鉴定机构职责的完善上,实行鉴定专家跨区域,避免“同行鉴定”之嫌,统一以抽签的方式选派鉴定人参与鉴定,同时规范鉴定的启动程序;在鉴定机构的内部治理结构上,加强对鉴定人和鉴定意见的事后审查,加强独立管理,摆脱行政干预,机构内部治理推行个人负责制。从而建立一个科学、合理的医疗责任鉴定机构,这也就可以解决当前存在很多矛盾纠纷。
[Abstract]:At present, under the dual-track medical responsibility appraisal institution, each medical responsibility appraisal organization is serving to resolve the medical dispute. However, due to the blur in the establishment, responsibility, governance structure and other aspects of the two appraisal institutions, there are contradictions in the appraisal opinions, which puzzles the resolution of disputes and the authority and effectiveness of the appraisal opinions. With regard to these problems, starting from the analysis of the current two-track appraisal institutions and their existing problems, and the development of the extraterritorial appraisal system, this paper puts forward a tentative plan to perfect the medical responsibility appraisal institutions. That is, the establishment of a unified identification of medical responsibility. For the sake of scientific standardization and unified management, a medical responsibility appraisal institution should be set up in the aspect of setting up appraisal institution, which should be equipped with qualified appraisal personnel. In the procedure of standardizing the appraisal institution, the starting procedure of the appraisal should be standardized, and the appraisal process should be made public; On the perfection of the duty of the appraisal organization, the experts should be carried out across regions to avoid the suspicion of "peer appraisal", and experts should be selected by drawing lots to participate in the appraisal, and the starting procedure of the appraisal should be standardized at the same time; In the internal governance structure of the appraisal organization, we should strengthen the ex post examination of the appraiser and the appraisal opinion, strengthen the independent management, get rid of the administrative intervention, and carry out the personal responsibility system in the internal management of the organization. Thus, a scientific and reasonable medical responsibility appraisal institution can be established, which can solve many contradictions and disputes.
