浅论专利法中的修改超范围

【摘要】：专利法第三十三规定了申请人可以对申请文件进行修改,但同时也规定了其修改不能超出原始申请文件记载的范围。然而,在审查实践中,判断修改是否超范围往往存在不一致的观点。本文首先简要介绍了各国关于申请文件修改的原则,接着通过对两个具体案例的分析,阐述了在实质审查过程中应当如何把握修改超范围的审查尺度,以期审查实践中标准执行一致。
[Abstract]:Patent Law No. 33 provides that the applicant may modify the application document, but also stipulates that the amendment shall not exceed the scope of the original application document. However, in the review practice, there are often inconsistent views in judging whether the modification is beyond the scope. This paper first briefly introduces the principles of the amendment of application documents in various countries, and then through the analysis of two specific cases, expounds how to grasp the scope of the review of the amendment in the process of substantive review.
