完全代孕的民事法律问题探究

【摘要】：由于我国不孕不育人群与日俱增,因此代孕的市场需求量呈不断增长的趋势,而我国现有的法律在代孕的问题上存在空白,只有卫生部发布的《人类辅助生殖技术管理办法》明令禁止医疗机构和医务人员实施代孕技术,从而滋生出许多地下代孕市场。在此,本文将对完全代孕问题进行研究,试图在我国有限度的承认代孕,以期能解决纷乱的代孕黑市带来的社会问题,并且给不孕不育夫妇带来希望的曙光。文章分为四个部分,第一章结合各国的法律和我国现实状况,通过分析代孕的方式,论证完全代孕的可行性,并定义完全代孕的性质；第二章为代孕的法律条件,从委托方、代理孕母、代孕中介机构三个主体进行分析论述,并讨论代孕子女亲子关系确定的法则；第三章为代孕的法律责任承担,主要探讨代孕协议的解除权,和终止妊娠后的责任分配；第四章是笔者根据前文对完全代孕的理论研究,拟分为启动和完成两个阶段设计法律程序。
[Abstract]:Due to the increasing number of infertile people in our country, the market demand for surrogacy is increasing. However, the existing laws of our country have a blank on surrogacy. Only the Administration of assisted Human Reproductive Technology issued by the Ministry of Health explicitly prohibits medical institutions and medical personnel from carrying out surrogacy technology, thus creating a lot of underground surrogacy markets. In this paper, we will study the problem of full surrogacy and try to recognize surrogacy in our country in order to solve the social problems caused by the complicated surrogacy black market and bring hope to infertile couples. The article is divided into four parts. The first chapter combines the laws of various countries and the reality of our country, through the analysis of the way of surrogacy, demonstrates the feasibility of full surrogacy, and defines the nature of full surrogacy; The second chapter is the legal conditions of surrogacy, from the client, surrogate mother, surrogate intermediary agencies to analyze and discuss the rules for the determination of parent-child relationship of surrogate children; The third chapter is the legal responsibility of surrogacy, mainly discusses the right to release the surrogate agreement, and the distribution of responsibilities after termination of pregnancy; The fourth chapter is a theoretical study of complete surrogacy, which is divided into two stages: starting and completing the legal procedure.
