论雇员执行职务行为的认定标准

【摘要】:我国在2010年实施的《侵权行为法》中正式规定了雇主责任,但是其构成要件的规定比较模糊,特别是所谓“执行职务行为”的认定并不明确。有鉴于此,本文在梳理雇主责任的归责原则及其理论基础,整理分析有关执行职务行为的相关立法、典型案例、学说理论的基础上,通过类型化方法,就如何认定执行职务行为问题,提出了一些自己肤浅的看法。本文除“引言”和“结语”外,主要由如下三个部分构成:第一部分“雇主责任概述”,主要介绍了雇主责任的归责原则、理论基础以及构成要件。第二部分“职务行为的认定”,从立法、司法解释、典型案例、学说理论角度,详细论述了我国有关职务行为认定标准的相关立法和司法解释以及主观说、客观说、综合说等学说理论。第三部分“职务行为认定标准之我见”,在分析有关职务认定的学说中的主观说、客观说存在的缺陷的基础上,论证了综合说的合理性。同时,对侵害行为进行类型化区分,就各种类型下的职务行为的判断,提出了认定标准。
[Abstract]:The liability of employer is formally stipulated in the Tort Law of our country in 2010, but the provisions of its constituent elements are rather vague, especially the identification of the so-called "executive duty act" is not clear. In view of this, on the basis of combing the principle of liability imputation and its theoretical basis, sorting out and analyzing the relevant legislation, typical cases and theory of executive duties, this paper adopts the typological method. This paper puts forward some superficial views on how to determine the behavior of performing duties. In addition to "introduction" and "conclusion", this paper mainly consists of the following three parts: the first part, "Overview of employer's liability", mainly introduces the principle, theoretical basis and constitutive requirements of employer's liability. The second part, "the cognizance of duty behavior", from the angle of legislation, judicial interpretation, typical cases, theory and theory, discusses in detail the relevant legislation and judicial interpretation, subjective theory and objective theory about the criterion of ascertaining duty behavior in our country. The theory of comprehensive theory. In the third part, the author analyzes the subjective theory and the defect of the objective theory, and proves the rationality of the comprehensive theory. At the same time, it classifies the infringing behavior, and puts forward the criterion of judging the duty behavior under various types.
